Clark Chapter of Phi Alpha Delta Law Fraternity International (PAD) began a new service to the community in the fall of 1988. The program, called “Freedom Day, took place immediately before Thanksgiving and was designed to help the less fortunate of Austin have something to be thankful for in these times of increasing poverty and hardship. The purpose was to collect food from law students to be delivered to, and distributed by, the Capital Area Food Bank. As an incentive to promote participation, professors of about one fourth of all law school classes agreed to give a pass on that day to any student who brought two cans of food to class. Hence, Freedom Day means one day of freedom from the Socratic method. The limited trial program was a big success, resulting in the collection of 1215 pounds of food. In coming years, PAD is planning to expand the program to include a greater number of classes and students and, hopefully, collect even more for the underprivileged of Austin. LITIGATION RAMBO STYLE The Student Bar Association sponsored a discussion of The Ethics of Rambo Litigation” in November. Speaking to a large group of students were Bill Brewer, a partner in the Dallas Firm of Bickel and Brewer, John McElhaney, a partner of Locke, Burnell, Rain and Harrel and a member of the Dallas Task Force on Ethics, and professor Jack Ratliff. Those favoring no holds barred” litigation stressed the need for vigorous representation of a client’s interests, as required by the codes of professional responsibility. Those opposing this approach argued that the true goal of our adversarial system, uncovering the truth behind a given dispute, cannot be achieved by the use of procedural tactics and wholesale intimidation. 8 — Litigation Rambo Style

LITIGATION BEGINS Litigation: the last resort of parties in dispute. Though only a tiny fraction of all controversies ever reach the courtroom, litigation is a full-time job for many attorneys. The l.aw School addresses this aspect of legal education in several ways, ranging from theoretical discussions of courtroom tactics and behavior, to classes which plunge students into the courtroom environment. The Law School’s skills” classes address client representation at both the lower court and appellate levels. Beyond the classes found in the Law School, however, are the numeroys mock trial competitions open to students throughout the year. Each stresses preparation, advocacy and composure under trial conditions, allowing students to hone their skills and further ready themselves for the real-world courts they will soon occupy. This year, the Spring senior mock trial finals were judged by Judah Best, chairman of the American Bar Association section on litigation, Benjamin Civiletti, immediate past chairman and Michael E. Tigar, chairman-elect. RIGHT: Karen Stuih pleads her case in competition form. BELOW: Witness Jon Givens describes a maritime disaster. 10 — Litigation Begins
