Don’t lose your perspective. Thus we are warned as we enter law school. Rarely do we understand or listen to this advice, especially as assignments pile up and exams approach. Amazingly, some students do listen and understand, or perhaps they’ve always possessed the inner fortitude to realize that a law school education is something of one’s own making, and not an imposition of a life style. These students are the independent thinkers in the labyrinth of Townes Hall. They expand the concept of a legal education by daring to pursue individual interests outside the confines of the classroom and library. The 1984 Peregrinus, therefore, is dedicated to those scholars who assume responsibility in the many law school organizations; participate in volunteer activities; write articles for publications; argue and prepare briefs for competitions; collect cans; donate blood; and, in general, give of themselves to help others. These are gifted individuals. Ward Professorship The dedication in the 1983 edition of the Peregrinus states that the late Bernie Ward was “one of the finest and most effective law professors that students ever had at Texas.” That feeling materialized this year into a monumental effort by over 100 law students, former students, faculty members, administrators, and community leaders. Together, they raised the funds from hundreds of contributors to establish the Bernard J. Ward Centennial Professorship in I,aw. A convocation was held honoring the professorship on October 25, 1983, in which Mrs. Elaine Ward was presented with a plaque signifying the honor. Professor Charles Alan Wright, the Honorable Thomas Gee, and Susan G. Conway provided glimpses intoWard’s life.' Fajita Fiesta Photos by Beu Cotton Photo by E Fall Hildebrand Moot Court Competition Second-year students Scott Ozmun and Dianne Carlson took first place in the October Fall Hildebrand moot court competition, beating out third year students David Holmes and Kim Lemons. Ozmun was named best speaker in the competition. Judges in the final round included the attorney who defended in the negligence case on which the moot court problem was based. Earlier in the fall, third-year students Cindy Smith and Susan Keahey won the seventh annual Johnson, Swanson novice mock trial competition. Smith received the best speaker award in the final round. Although law school is a highly competitive environment, most students leave with a sense of regret and a little apprehension over the imminent bar exam and a new, highly competitive working environment. Photos by Phillip Barr 22 The Sunflower Ceremony is a unique tradition which stemmed from a disagreement over academic regalia in the University’s early years. Although no caps and gowns had been worn from the founding of the University of Texas in 1883 till the turn of the century, a salesman at that time persuaded the senior class to adopt the tradition. Not having been consulted on the decision, the law students refused to comply on the grounds that caps and gowns were inappropriate for a professional, non-academia school. Faced with an ultimatum from University officials, the students finally agreed to wear white suits and chose the sunflower to represent their distinctive insignia. The sunflower was chosen because like lawyers, it is widely distributed throughout the world, and it turns its face to the light of the sun just as the lawyers turn their faces to the light of justice. The use of the sunflower has not only survived, but is one of the school’s most cherished traditions. 23 Texas Attorney General Jim Mattox Texas State Attorney General Jim Mattox addresses law students on the benefits of state employment during the SBA Fall Law Forum. A total of 1700 cans and $400.00 was distributed to various charities in Austin through the Capital Area Food Bank. David Maldonado, Food Drive Coordinator, holds the first can donated. Sutton is stepping down as Dean of the University of Texas School of Law in order to return to teaching. Why give up all that power and prestige? “Teaching is my love,” he says in his “good oP boy” Texas drawl. “I love the classroom, and I like to write. I gave up practicing law in order to have the fun of teaching and writing. I want to return to that fun again,” he explains. “Besides, I will have served my five years as Dean. The average tenure of law school deans is three years.” Those five years have resulted in many changes in the Law School. Sutton is most proud of the reorganization of the administration. After accepting the deanship, he selected two associate deans to assist him in academic affairs and administration. He added an assistant dean, set up rigid lines of authority, established policies and improved procedures. “When the Law School started, one Dean could run the school part-time, and keep everything in his head. Today there are more students, buildings, government regulations, laws and red tape.” Sutton says he found his experience as an FBI investigator invaluable during his tenure as Dean. “The FBI is highly organized. I was a resident agent with my own sub-office and got management experience through there.” Among other accomplishments in the last five years are the growth of the law library, the improved physical facilities, (which Sutton proudly claims may be the best in the U.S.), an increased awareness by the faculty of the need for scholarly research, better classroom teaching and a better and larger faculty. Sutton also cites a new appreciation of the need to improve the law school curriculum, which he says will take a number of years to accomplish. “It’s like turning an ocean liner around. But the tugs are at work,” he says. “It occurred to me the other day that if a fellow stayed on as Dean until all the problems were solved, he’d be there for 40 or 50 years. Sutton says there are parts of the deanship that he will not miss. The “command performances” — parties, dinners and receptions, take up a lot of time and do not help a diet. “You get fat being Dean — I gained nine pounds in three months,”he says. Phillip Barr He now jogs to make up for all those dinners. In addition, he says he found the time spent resolving minor disputes and problems to be frustrating. You’re maintaining the status quo — there’s no progress,” he says. Sutton’s chief satisfaction comes from being in the classroom. He has taught a class or seminar each semester since he has been Dean. He holds the William Stamps Farish professorship at the University, and teaches Evidence, Professional Responsibility and Torts. He compares teaching classes to trying a case. “You never know what’s going to happen. There’s a lot of give and take. It’s a battle of wits,” he explains. Sutton also enjoys writing, and has co-authored an Evidence casebook. He is currently working on a Professional Responsibility casebook and is planning to write a Professional Responsibility hornbook. Sutton describes the chief advantage of being a professor simply: an attorney only writes and researches problems clients bring to him. But professors get to write about anything that interests them personally. 34 — Dean John Sutton Urn to trclicRitu] Sutton claims he knew he was going to be a lawyer when he was seven years old. “I grew up around law. When I was in junior high, my father was a judge in San Angelo. I used to sit in the courtroom listening to cases, waiting for recess so I could get a quarter for a movie.” After graduation from the University of Texas School of Law in 1941, he worked as an FBI investigator for four years. He then entered civil trial work, first with a San Antonio law firm, then as a partner in the firm of Sutton, Steib and Barr in San Angelo. He joined the UT faculty in 1957, teaching 35-40 hours of different courses, until he found his niche in Evidence, Torts and Professional Responsibility. Sutton is one of the co-drafters of the American Bar Association’s Code of Professional Responsibility. In September, 1983, he was elected a Fellow of the American Bar Foundation, the research affiliate of the American Bar Association. One of his most prized possessions is the chair his father used as district judge in Tom Green County. Sutton had the chair for years in his own office. He has now passed it on to his son, a tax lawyer in San Angelo. Sutton’s wife, Nancy is also an attorney, serving as an assistant attorney general in Texas. They also have one daughter who lives in Washington. Upon stepping down as Dean, Sutton hopes to take a research leave in order to complete work on his books. Gibson’s August 31, 1984 retirement, the common response among law students is, “but, who will I go to with my problems?” The slight man still represents the small school atmosphere seldom found in such a huge school; he maintains a no appointment necessary policy for students. “I’ve enjoyed working with students, Gibson says. “Being a law student is a very temporary thing, but these people will be members of the Bar for a long time.” He describes UT law students as an elite group of people. “We expect more from them because of their age and their maturity” he says. He smiles as he reminisces, telling humorous stories about the students he has met. Gibson, a native of East Texas, received his B.A. in English in 1939. With an English major and German minor, he worked as a school teacher until World War II changed his career plans. He entered the U.S. Navy in September of 1941, serving as a Communications Officer and Commanding Officer of a landing ship. His admiration for his uncle, an attorney, caused Gibson to consider law as a career after WWII. “I’ve always liked lawyers because they’re always willing to listen and talk. That was one of the main reasons I went into law,” he says. Gibson entered the University of Texas Law School in 1946, turning down an offer to teach school in Robstown. “I’ve never been disappointed in my decision,” he says. At that time, law school classes started on March 1 and ran until June 1, Photo by Phillip Barr with students taking six hours each of Contracts and Torts, and two hours of Personal Property. “It was great, he recalls, “only three final exams.” While in law school, Gibson discovered that he enjoyed legal research. He later served as State librarian from 1953-54 and returned to UT to work as an assistant librarian in 1954. He was promoted to Assistant Dean in 1956. He and Page Keeton, then Dean of the Law School, ran the entire school of 900 students from their two offices. At that time, he handled Placement, Admissions, Continuing Legal Education, Law School Foundation, and Student Activities. He has taught legal writing and research at UT and is currently an Associate Professor. Gibson has watched the continual expansion of the Law School, “We had our largest student population in 1971 with 1702 students. This fall (1983) we had 1640.” Gibson remembers the numbers easily; his functions still include duties in Admissions and the Main Office, preregistration and registration. “1 figure I’m the most unpopular man in the law school,” he says. The majority of students who apply to UT are rejected. Those who are accepted get a letter from the Registrar. Those who are denied admission get a letter from me. I try to make the letter as nice as possible,” he adds. He is proud of his part in keeping the history of the Peregrinus alive. In his office are two statues of the animal he describes as “the patron saint of the Law School.” One is a small papier-mache figure, the other is a large, solid piece created by the famous sculptor Mansbendel in 1916. Rivalry in the 1920s between the law school and the engineering school prompted engineering students to steal the two statues, with periodic retaliations by law students. They stole the Engineering school’s cigar store Indian. The last reported theft of the Peregrinus was in 1979 when Gibson walked into his office and discovered both statues missing. Again, the culprits were engineering students trying to revive UT traditions and spirit. Law students have not been without blame, however. Gibson recalls the time the Petroleum Engineering building’s huge oil derrick showed up in the lobby of the law school. When asked what he plans to do upon retirement, he replies, “nothing,” with a satisfied smile. The Environmental and Natural Resources Law Society (ENRLS) was established in the Fall of 1982 by an initial group of five students. The current membership of seventy-five includes students with experience in environmental agencies, public interest groups, consulting, engineering, economics, and a variety of other backgrounds. The members of ENRLS are united by a common interest in opening channels of communication between law students, teachers, and practitioners so that all will be able to make more enlightened contributions to environmental and natural resource law. The ENRLS is engaged in several activities on campus. The organization is seeking to have more environmental law courses added to the law school curriculum. The ENRLS sponsors seminars on careers in environmental law featuring experienced practitioners. The society has prepared a pamphlet to help students plan a curriculum emphasizing resource law. The most visible pro- ject, the recycling of aluminum cans on campus, is being used to generate funds for an eventual student scholarship. For teachers, practitioners, and students, the ENRLS is organizing a Texas Administrative Law Workshop to be held in the Spring of 1984. The workshop will feature representatives of various Texas administrative agencies and will emphasize the role of these agencies in environmental and natural resource regulation. The Myers-Briggs Type Indicator (MBTI) Legal Careers Project was an empirical research project investigating the relationship between type description and area of specialization in law and between type description and career progression in law. Dean John F. Sutton and Associate Dean Mark G. Yudof sponsored the project, and the Placement Office conducted the research. The Student Bar Association supported the project in many ways. Members of the LRB research and write memoranda of law for practicing attorneys throughput the country. While the LRB provides a valuable service to the Bar, its primary purpose is to refine the research and writing skills of its members by affording them an opportunity to work with actual problems and consult with practicing attorneys. LRB members enjoy the ad- ded incentive of being paid for their efforts. Imitations to membership are extended on two bases: outstanding performance in the first year Legal Research and Writing class, as evidenced by receipt of the highest grade in that class; submission of a superior memorandum of law during the LRB candidacy program. This publication’s inspiration, the Peregrinus. The Peregrinus is a Law School institution. Although publication ceased for a few years in the ’70s, student and faculty interest revived it. While the editorial staff is small, individual students have graciously contributed many photographs and information. This combined effort has produced the 1984 Peregrinus. Peregrinus, a nondescript animal, symbolizes both in limb and attitude the maxims in equity that guide the administration of the system. On one of the front feet as originally drawn was an Irish ditcher’s boot indicating the law’s protection to the least of mankind. On the other front foot were claws, indicating that the greatest of mankind must fear its power. The arched back represented that the law was ever ready to protect right or prevent wrong. The beak demonstrated the power to penetrate the mysteries of the law. The bushy tail indicated that equity brushes away the technicalities of the law and does justice to the merits. The Real Estate Law Society was founded in the Fall of 1983 as an educational organization to supplement classes with presentations by professionals in all areas of the real estate Field: brokers, attorneys, and developers. Real Estate Law Society — 75 The Review of Litigation The Review of Litigation responds to the need for a national forum for interchange of academic and practical discussion of various aspects of litigation. The articles, notes, and symposia focus on the interface between theory and practice in the trial and appeal of lawsuits, and allow academician, litigator, and judge to better understand their functions in the litigation process. Now in its fifth year, 'The Review has gained national acclaim in achieving its goals. Student staff positions are filled through candidacy programs conducted in the fall and spring. Additionally, first year law students who win select moot court competitions may be invited to join. During the past year, The Review also began considering outside submissions of publication-quality student lawnotes. Through each of the admissions programs, The Review seeks qualified students based solely on legal writing and reasoning ability. Advantages of membership include exposure to the issues at the forefront of Texas and national litigation, the opportunity to write and soon thereafter publish a lawnote, and the chance for the individual to make a significant contribution to a relatively young organization already having an important impact on the litigation community. Its aims include the promotion of research and educational programs addressing aspects of the law of concern to women, the discussion of creative responses to these issues, the recruitment of women interested in legal careers, and the creation of a social and political support group for women students. Women's Law Caucus — 87 Board of Advocates The Board of Advocates (BOA), sponsors and promotes the study and practice of trial and appellate advocacy. It administers all moot court, mock trial, and client counseling competitions. The BOA sponsors a variety of advocacy related lectures. Members are given opportunities to administer and participate in BOA events, achieve recognition for outstanding oral advocacy, and enjoy substantial contact with local attorneys.
