JUSTICE TOM CLARK “His company was unfailingly pleasant, whether he was asking me about some legal question while I stood at the bar of his Court arguing a case, or we were on some lighter subject at some other bar. ” 6 — Tom Clark By Charles Alan Wright, McCormick Professor of Law The death of Tom Clark was a loss to everyone around the country who is concerned with improving the administration of justice, because no one devoted himself more effectively and tirelessly to that cause than did Justice Clark. The loss was felt particularly keenly at this Law School. Justice Clark was the School’s most distinguished alumnus, and he was always more than generous to the School. Several of his law clerks came from Townes Hall, and many times he returned here to educate and inspire new generations of students. But quite aside from all of this, many of us here, upon hearing of his death, felt deeply the loss of a friend. I have great respect for the record of solid judicial accomplishment he built in 18 years on the High Bench. Indeed the last time I saw Justice Clark before he died was at a cocktail party in Washington in May. I was chatting with Justice Blackmun and Justice Clark and congratulated the former on his spendid opinion for the court a few weeks before in Complete Auto Transit v. Brady, 97 S.Ct. 1076 (1977). That case unanimously overruled the Court’s decision more than a quarter of a century before in Spector Motor Service v. O'Connor, 340 U.S. 602(1951). Justice Clark had written a powerful dissent in the Spector case, and Justice Blackmun explained to him: “Tom, we've now made the law what you said it ought to be 26 years ago in Spector.” But though I respect what Justice Clark accomplished on the Supreme Court, and am awed by his conributions to reform of the courts, I, like so many others, miss most this warm, human, friendly man. Judge Learned Hand was fond of referring to the United States Supreme Court as the novem beati, “the nine blessed ones. There have been those in history who, after going to the Supreme Court, have acted as if they had become beati, but Tom Clark always was aware that he put on his robe one sleeve at a time. Despite the high offices he held and the honor he rightfully received, he always remained a decent, down-to-earth Texan with no airs — not even justified ones. He liked people whether they were a President of the United States or a young law professor, and they liked him. Our relation had a somewhat unfortunate start. In the summer of 1949,1 had graduated from Yale Law School and was waiting to go to work for Judge Charles E. Clark of the Second Circuit. There were two vacancies on the Supreme Court that summer. One morning in the hospital where I was recuperating from an accident, a nurse mentioned that the President had made an appointment to the Supreme Court, “someone named Clark.” For an hour, I had delicious visions of clerking for the Supreme Court, and was quite let down when I got the full details. I even felt some resentment that President Truman had named the “wrong” Clark. But I was then very young — and did not know Tom Clark. When I came to know him a few years, later, I realized how unjustified my resentment had been. I had the privilege of being with him many times over the years, and the meetings were always too brief. His company was unfailingly pleasant, whether he was asking me about some legal question while I stood at the bar of his Court arguing a case, or we were on some lighter subject at some other bar. I recall a small dinner party given for Justice Clark in Washington a few years back, in which my wife and I were privileged to be included. Some of the 24 guests were famous; others of us were entirely obscure. Our common bond was that we were all friends of Tom Clark. It was one of the most pleasant and memorable evenings of my life, for the affection all of us felt for the Justice was so apparent. He inspired that kind of affection from everyone who knew him whether in high places or low. On the wall of my dressing room at home I have a picture of Justice Clark and his distinguished son, Ramsey, with an inscription in the Justice’s unmistakable hand; “To Charlie Wright from the Clark boys.” It is good to be able to look at that every monring, to be reminded of the important values that shaped Tom Clark, and to think of what a splendid person and dear friend he was. “He liked people whether they were a President of the United States or a young law-professor, and they liked him. Tom Clark — 7 8 — Construction After enduring an earth-shattering year of dynamite blasting and riveting, UT law professors ventured forth from their offices to ■•check” out the progress of the Townes Hall addition. One observant pedagogue discovered that the newly-poured concrete was several inches higher than the existing wing. Construction engineers assured the faculty member that he was making a mountain out of a mole hill and insisted that the institution of higher learning was appropriately plumb. However they investigated the problem area. Much to the dismay of law school administrators, the builders discovered that a discrepancy did exist. The workers caucused to remedy the situation and were overheard to ask, Didn't this same thing happen over at the Graduate School of Business a few years ago? Barring any other unforeseen difficulties, the new addition, which will house the library and offices, is scheduled for completion in 1979. Construction — 9 CE T Willie K. Says When Willie Kocurek entered law school in 1943, no graffiti was written on the walls, “but everyone carved initials into those old desks. Kocurek is now back to complete his degree. Dean T. J. Gibson readmitted him under the Grandfather's clause. “The Grandfather's clause permits you to come back in. It doesn’t disqualify anyone else — Grandfather students are over and above the quota. Under this return clause, you must have a minimum of 10 credits, Kocurek said. He did not have to take the LSAT, and his GPA carried over with the original credits. Kocurek said that his wife Maurine was “delighted when he decided to return to law school. “In my renewment age, I feel very energetic,” he said. When he originally attended UT Law School Kocurek took a course from Dean Ira Hildebrand. We have some fine law professors now, too. I like all the ones I have,” 67 year old Kocurek said. “Acquaintance with legal research is the most difficult and fundamental part of his return to law school. “I find it easy to study. My difficulty now is learning the lav library. “I must say that my fellow students are treating me just splendidly. I've made all TQ functions in the realm of my territory, and Mrs. Kocurek has gone with me. Mr. K and his wife, won't miss any home football games. And we sit on the student's side. It’s Too Late, Baby “ 'Twas the night before Oil and Gas Exam, and there I was watching Earl win the Heisman. I dashed to the streets. Emblazoned on the orange-colored tower was a huge Number 1. Along with thousands, I shouted, We’re Number One.” Returning to my chilled apartment at two o'clock the next morning, I realized that in six-and-a-half hours I would be answering questions over oil fields as yet unstudied. How difficult could multiple choice be, anyway? $$$$$$$$$. In 1977, a student walked into Anna Saldana's Office and filled out several forms to get financial assistance. Saldana, the administrative assistant in charge of the law school’s scholarship and loan program, carefully checked the records and discovered that the applicant was not a law student. Apparently, he had been misdirected when he asked for UT financial aid. Saldana, mother of 10 children, has worked at the law school for 13 years, eight years in loans. On her office wall hangs the sign “Loaning money causes amnesia. In marked contrast to that sentiment, many students return to see her after they graduate from law school. 10 —EtSeq. Violation “As of Jan. 9, 1978, this area will be reserved for faculty. Posting of that sign removed from student domain the last remnants of parking nearby the law school. The street between the Band Hall and Townes Hall no longer displayed the quarter-eating parking meters. F-stickers blazed everywhere. Have a Seat Professor Roy Mersky invited 40,000 UT undergraduates to visit the Law Library. Although he later qualified his statement, irate law students prepared for the onslaught of sophomores carrying paperback copies of Norton’s Anthology. Man From Glad Every day between 10:30 a.m. and 1:30 p.m., Earl Wright sells Salvation Sandwiches to hordes of hungry law students. A large placard serves as a menu to list delicacies such as avocado-cheese, egg salad and ham salad sandwiches, bialys and banana bread. Spiced tea washes down the meal. Wright has worked for Salvation Sandwiches for five and one-half years. All but the first month of his tenure have been spent at Townes. My sales used to be better when I worked in the breezeway. Now I only go on campus when it rains, he said. Wright and his ice chest are stationed down the hill from law school on 26th Street. Hot Off a Cold Tile Et Seq. — 11 12 — Sports LEGAL EAGLES: Erie R. R. Co. tried to take away our gusto, but we derailed 'em. •'Ar d Terry, this is in lieu of an Am Jur Heil Pigskin! Salvaging their honor on a muddy Eastwoods Park field, the faculty barely nipped the Illegal Eagles in what turned out to be a closely-fought battle. Prof. Gary “The Bully’’ Powers considered turning pro after emerging as the star faculty player. Despite valiant efforts by Laird Lawrence and Rene McClellan, the faculty prevailed over the women 14-12. In intramural play, the Illegal Eagles finished with a perfect 5-0 record easily winning their division. However, they fell in the championship game to archrivals Our Gang. In the men’s division the Legal Eagles romped their opponents and took the Law School championship. Despite their loss to the Eagles, Erie R. R. Co. hosted a banquet at the Back Door and invited Coach Wright and his team as special guests. Former UT Head Coach Darrell K. Royal keynoted the invitation-only fete. Sports — 13 Talk of the Townes Q . How many hornbooks and outlines have you purchased? Have they helped? Which type do you prefer? RICHARD WILENSKY: My sister gave me hers free of charge. They definitely help. I'd rather read outlines than the casebooks, Gilbert’s is better than Co op East or Coif.” THOMAS BAIRD: Yes, I've use many. There’s been more than one course that I’ve made it through on the outline. I don’t have a favorite brand ... I use Gilbert’s, Co op East or an individual’s. Hornbooks are too cumbersome. Richard Wilensky Thomas Baird Q . In October a questionnaire was filled out by students regarding Pass Fail. Do you believe there should be such a system? GREG DILLION: Yes, but not necessarily as it was stated on the questionnaire. I'd like to see it mandatory for the first semester. The way they do it now, the first semester tests don't count for much anyway. JO ANNA VERNETTI: I approve of a pass fail system. However there should be a limited amount of pass fail courses. If the system is implemented, students shouldn’t have to make a decision within the first month. They should be able to feel out the course before making a decision. If you had it to do over again, would you have delayed starting law school until the new building was completed? SHENETHA MANUEL: Well things are inadequate here. Have you ever gone through the hall? I rush out of class to avoid the mob. But no, I wouldn't have delayed.” STEVE WELCH: Sure things are inadequate. That’s why I’m studying in the hall. I’m really mad about it. The study rooms and libraries are packed, so I just grab a portion of the hall. I wouldn’t have delayed starting law school, but I might have considered going somewhere else. When I looked at this school there weren’t the masses.” Steve Welch Penny Nicholson Q • Briefly, what are your views on reverse discrimination and the Bakke case? PENNY NICHOLSON: The numbers system for selecting people for law school, taken alone, is a very good method. It tends to produce a homogeneous student body. However, selection committees should take into consideration factors such as educational disadvantages and families who can’t afford to send their children to school. I don’t really know how the Supreme Court will decide Bakke.” BILL BRADEN: I’m for reverse discrimination. I think we need minorities for the two major professions, law and medicine, more than we need numbers in the profession. Midterm Exam — 15 Practical programs were designed to teach law students how-to-doit. Moot courts and mock trials allowed students to test their silver tongues outside the classroom. Strasburger Trial lecturers gave students lessons on litigation strategy and tactics. Hildebrand Moot Court participants argued petitioner and respondent sides of various cases and controversies. Locke Mock Trial Competition taught budding prosecutors how to put criminals away and defense attorneys how to sway the judge and jury. 16 — How To I just love costume balls. No one remembers how many years the Fall Drunk has been held, it’s hard enough to remember the night itself. The SBA sponsored the event and served hairy punch, beer and mixed drinks. At this year’s revelry at Fiesta Gardens, The Texas Chain Saw Massacrer cut in on dancing couples, a caveman did the dance of the skins and the Tuts took time from the tomb to attend. Eyes were redder the next morning than the night before finals. “I want my mummy! I'd like to introduce Dorothy and Toto.” Fall Drunk — 19 suimoweR In the early 1900’s, the administration neglected to ask law students their opinion as to what type of graduation regalia to wear. So instead of donning caps and gowns, law students gathered some of the abundant sunflowers and pinned them on their lapels. 20 — Sunflower Ceremony C€R€MOfiY Construction depleted grassy areas of campus and sunflowers became scarce. Plastic sunflowers, purchased by the law school administrators, now symbolize the newly-turned alumni. At these commencement exercises, each graduate introduces his family and friends to the assemblage. Sunflower Ceremony — 21 Retiring professors, Albert Jones and Gus Hodges receive bronze Peregrim. LAW Judiciary members preside over Hildy finals. Chock full of activities, the Ninth Annual Page Keeton Law Week was dedicated to Prof. Albert “Pappy” Jones who retired from teaching at the close of the spring semester. Held from March 24 to April 2, 1977, the week's events included Hildebrand Finals, Awards Day, speakers, a Spring Fling at Billy Shakespeare's and culminated with Assault and Flattery. W. Supplementing the state appropriations which make up salaries, the LAW SCHOOL FOUN DATION general endowment fund helps secure outstanding faculty. The Foundation is a private non-profit corporation chartered under the laws of the state of Texas. While fewer than 6 percent of University of Texas School of Law graduates donate money on an annual basis, the LAW SCHOOL ASSOCIATION worked without membership fees to provide funds for the Law School. Both the Foundation and Association are striving to reach alumni and encourage them to contribute to the annual gift program to bring annual gifts in line with other outstanding law schools.
