The Bicentennial Year The 1976 Peregrinus The University Of Texas School Of Law Volume 26 Published By Texas Student Publications Austin, Texas Peregrinus Staff Deborah Smith Editor- In -Chief Cal Chaney Neal Holifield Laura Kislin Barbara Linch Tom McKnight Bill Ogden James Rader 2 The Peregrinus. patron saint of The University of Texas Law School, was born in 1900 as the result of a humorous incident in Judge W. S. Simkins’ Equity class. The Judge had explained to a befuddled student that Praetor Peregrinus was a chancellor who traveled, or peregrinated, among the provinces of the Roman Empire to settle legal disputes. A caricature of the Peregrinus as a hybrid beast of Equity then appeared on the class blackboard. The physical characteristics of Peregrinus have gradually developed traditional meanings. The sharp beak fights injustice and probes for truth. The boxing gloves on the rear feet represent the Law's power to strike down those who stand against it; the worker’s boots on the front feet symbolize the protection accorded the common man. The bushy tail stands ready to brush aside deception and any legal technicalities which obstruct equity. The arched back shows a readiness to spring forward to do justice, while the hind quarters are those of a dog-man's best friend. fable Of Contents Activities 8 Faculty And Staff 28 Organizations 54 Classes 82 Index 132 3 5 7 8 6 S3I1IAI10V Lorene Rogers’ Appointment On September 12, the Board of Regents took action which normally would have been regarded as a landmark event in educational history, by appointing Lorene Rogers as the first woman president of a major state university. Instead of applause, however, the appointment sparked a chorus of protest from every segment of the University. The Regents’ vote (5 to 3, with James Bauerle. Lady Bird Johnson and Thomas Law dissenting) culminated what many viewed as a series of arrogant and myopic Board decisions. The most recent previous wave of controversy had arisen when Chancellor Charles LeMaistre abruptly fired President Stephen Spurr in the fall of 1974. In the wake of Spurr's dismissal. Rogers was named president ad interim, and a Faculty-Student Advisory Committee was formed to recommend presidential candidates to the Board of Regents. Final authority to make a selection lay with the Regents, but it was widely assumed that they would draw a successor from the Committee's list. The Faculty voted to accept only nominees from the list. The overt reaction of law students to the appointment was relatively mild, but private dissatisfaction was widespread. The unanimous call by the SBA Board of Governors for a class boycott was largely ignored. But 200 law students marched to the Governor’s Mansion to call for Roger’s resignation, and an SBA poll showed overwhelming disapproval of the selection. Even the Women's Law Caucus deplored the process by which a woman had finally become president of the University. Regents Allan Shivers. Ed Clark and Thomas Law joined Advisory Committee members James Kinneavy and Charles Alan Wright in a panel discussion which packed the Law School Auditorium. Professor Wright stated that attributing the turmoil to faculty-student dissidents was akin to claiming that the Washington Post caused Watergate. By December, Rogers was firmly entrenched, but law students and others began formulating means to combat what Professor Albert Alschuler (in resigning from the faculty) called the contempt” in which the faculty and students are held by the Regents. Speakers John Henry Faulk Many prestigious speakers ascended the podium to enlighten interested students on a range of law-related topics sponsored by this year's speakers program. United States District Court Judge Charles B. Wyzanski gave students insight into how a judge makes decisions. Discussing the importance of individuals in keeping the system going. Texas Attorney General John Hill charged his audience with the rep- sonsibility of increasing public interest in the nation's professions. In his speech on The Adversary Judge. the Honorable Marvin E. Frankel. United States District Judge for the Southern District of New York examined the role conflicts which face the supposedly impartial judge. One-time black-listed humorist John Henry Faulk displayed his wit and explained his trials during the McCarthy era of the 1950's. 13 Voter turnout was larger than expected over the contoversial issue. “The decisions I made ... were made in a good faith effort to fulfill my responsibilities although there are many points at which I might have made different decisions.’' — Darwin McKee 14 No Confidence, Students Say McKee Must Go Reprinted from The Texas Law Forum, Vo. 17 No. 4 The students of the UT School of Law voted December 2 to recall Darwin McKee from the presidency of the Student Bar Association. 1014 students — 58% of the electorate — voted; the final count was 610-402, with two blank ballots. The recall vote was prompted by McKee’s attendance at an American Bar Association Law School Division (ABA-LSD) convention held October 10-12 in New Orleans. McKee obtained $200 from the Student Bar Association (SBA) and $300 from the Law School Foundation to attend the meeting. He was later severely critized because: •he told neither group the other was funding him. •he was accompanied by Nathan Johnson (vice-president of the Thurgood Marshall Legal Society, a member of Project Info and McKee’s roommate), when the Foundation and the SBA assumed he would go alone, and, •the two flew first class, which is against both Law School and University policy. McKee indicated that he felt the choice of a traveling companion was a matter for his discretion and any failure to inform others of plans was due to a lack of time. The first class tickets were a spur-of-the- moment decision based on the length of Johnson’s legs, he said. Testimony from those involved reconstructs the background events as follows: McKee originally planned not to attend the ABA-LSD convention, but was finally persuaded to by Ulysses Jones, governor of the ABA-LSD 13th Circuit, on grounds that 1) the ABA-LSD would reimburse part of the travel cost to those attending, 2) UT’s representation would help McKee decide whether or not UT should continue its participation in ABA-LSD, and 3) participating law schools would be eligible to seek grants for minority, women’s and general programs if at least 20 per cent of the student body were dues-paying members of the ABA-LSD. McKee had contacted Associate Dean Byron Fullerton and on Wednesday. October 8. Fullerton told McKee by phone that he had approved the request. McKee then requested $200 from SBA treasurer Steve Udell. Apparently McKee at no time informed either Udell or Fullerton of the other's funding or of Johnson’s accompaniment. A petition calling for McKee's recall, signed by 109 students and certified by Election Commission Chairman Gary Landers, was submitted to the Election Commission Board on November 13, and December 2 was chosen as the recall election date. According to its originator, Lee Kaplan, the petition was meant to point up a need for a complete and candid explanation. 15 Student Bar Association hearings ended m a no confidence vote. Strasburger Trial Lecture Series The Strasburger Trial Lecture Series had its first full season in the fall of 1973 and has operated each fall under the direction of the Trial Division of the Board of Advocates. This lecture series has been endowed by a grant to The University of Texas Law School Foundation by the Dallas law firm of Strasburger. Price. Kelton. Martin and Unis in memory of Henry W. Strasburger. Mr. Strasburger. who died in 1972. was one of the most respected trial attorneys in Texas. The series provides law students valuable lessons on litigation strategy and tactics learned in the heat of courtroom battle. Royce R. Till. RIGHT COLUMN: W. Douglas Matthews. Percy Foreman. 17 Moot Court And Trial Competition This year the Board of Advocates administered ten trial and appellate advocacy competitions. Intrascholastic competitions included the freshman appellate competition within the Teaching Quizmasters program, an appellate competition in the fall open to all second and third year students and its sudden death finale in the spring and a trial competition. Interscholastic competition included State Bar Competition, National Moot Court. International Moot Court. Patent Moot Court and Client Counseling. Locke, Purnell Mock Trial Competition The Locke, Purnell Mock Trial Competition was held at the Law School October 10-15 and two finalist teams were chosen to advance to Region X competition. The first place team was composed of Scruggs. Bivens and Atlee; the second place team was made up of Selz, Sewell and Finley. Chris Scruggs and Craig Eggleston were the best advocates. The University served as host for the regional competition January 29-31. The two University teams ad- vanced to the final round and took first and second place. The first place team was Selz. Sewell and Finley and the second place team was Scruggs. Bivens and Atlee. Both teams went to Houston for the national competition sponsored by the State Junior Bar. Jessup International Law Moot Court Competition The University team was chosen in local competition on December 2 and traveled to Tulsa. Oklahoma, on March 5-6 for the regional competition. When rational arguments fail ... force is the ultimate international solution. National Moot Court Team University tryouts for the Moot Court Team were held on September 17. The team went to Dallas on October 31 for the regional competition and placed third. .Team members were from left to right: Mike Mullen, Craig Oliver and Lee Kaplan. 19 Qualifying for Spring Brief Awards Hildebrand Moot Court Competition Over 40 teams entered this year’s Hildebrand Moot Court Competition. The participants submitted their briefs on November 3 and met in four rounds of competition between November 10 and November 21. The three top-ranking teams from each bracket qualified for the spring competition held in February and March. The final round was judged by the Texas Supreme Court. Summer graduates participated in the traditional Sunflower Ceremony on October 19. The custom dates back to the turn of the century when law seniors, who had not been consulted by undergraduate seniors in their decision to wear caps and gowns to graduation ceremonies. decided to wear white suits with sunflowers pinned to their lapels. The sunflower was chosen because of its worldwide distribution; lawyers too are international. Further, the sunflower keeps its face turned to the sun as a lawyer turns to the light of justice. 21 22 Marcia Ball provided music to do the mash, of course ... the monster mash. Leaving the hallowed halls of Townes, law students journeyed to Fiesta Gardens to enjoy a spirited All Hallow’s Eve. Volunteer bartenders sampled and mixed potions guaranteed to help conjure up visions of Salem Witch Trials. Each year the Student Bar Association sponsors the event which, for obvious reasons, is often called the Fall Down Drunk. To gain entrance, each student is charged a simple fee. You run around this ant Faculty Flags Down Illegal Eagles With revenge on their minds, faculty members fought hard to defeat the Illegal Eagles 16-14. Texas Supreme Court Judge Joe Greenhill presided as head referee. The faculty team, led by quarterback Pat Cain, was behind 14-8 at the half, but rallied late in the fourth quarter. The series is tied at 3 all. 27 Faculty And Staff 29 Deans Of The School Of Law Ernest E. Smith Dean 30 31 Law School Foundation Since its inception in 1952. The University of Texas Law School Foundation has played a vital role in the Law School's steady growth to a position of national ranking in legal education. The Foundation is a private non-profit corporation chartered under the law of the State of Texas as an educational foundation. Its sole purpose is to assist the Law School by providing extra financial support unavailable through the normal University channels. The Foundation assists the Law School in many ways. It aids in securing and holding outstanding faculty by means of the income from general endowment as well as the income from endowed chairs and professorships. The Foundation also serves as a depository for annual gifts to provide scholarships, student loans and employment, faculty recruitment and travel for professional development. and miscellaneous supplies and equipment for which there are no state appropriations. The Board of Advocates directs the tryouts for The University of Texas teams which participate each year on National. State, and International Moot Court competitions. The board is open to second- and third year students who become eligible by participation in a candidacy program involving the performance of administrative duties, brief writing and oral advocacy. Since 1912 the order has been carrying out its purpose of honoring law students who. by consistent scholarship and academic achievement, have shown themselves likely to succeed and become credits to their profession. Delta Theta Phi The Sam Houston Senate of Delta Theta Phi provides a needed outlet for law students who wish occasional respites from the routine of classes. An active social calendar with activities at least twice monthly is an essential part of the Delta Theta Phi program. In addition, the fraternity sponsors speaker programs and holds an annual spring banquet honoring prominent alumni. At the 1975 banquet, held in April at the Lila B. Etter Alumni Center. Texas Law Review The Law Review faced several controversial issues in 1975 and 1976. Foremost among those was a question concerning an 11 month deadline requirement during which time a candidate must publish a casenote and have prepared a comment or face possible dismissal from the Law Review. This requirement was instituted to generate more manuscripts for the Law Review. A second issue concerned the officers and their amendment to the bylaws allowing only outgoing officers to vote for new officers. There is no preliminary competition or other procedure for choosing staff members for the Urban Law Review, but only work selected by the editorial staff is published. John Lange serves as editor-in-chief. 80 Women’s Law Caucus The Women's Law Caucus is open to all who are interested in issues and activities furthering the rights and opportunities of women. Since the group organized in the fall of 1970, projects have been carried out through committees to allow women to focus their attention on whatever project interests them most. Smith 146 Conference On Transnational Economic Boycotts Professor Susman listens intently to Lionel Kestenbaum of the firm of Bergson, Borkland. Margolis and Adler in Washington. D C. Kestenbaum spoke on Antitrust Implications of the Boycott. The Conference was a regional meeting of the American Society of International Law. It was held at the Thompson Conference Center on February 19 and 20. Many well recognized authorities in the area of international law participated as speakers. Subjects included the response of multinational corporations, the legal aspects of the boycott, human rights implications. concerted actions such as OPEC, effects of the oil cartel, and antitrust implications. Phillip Areeda of Harvard Law School addresses some comments to the conference following Mr. Kestenbaum’s speech. 147 Payne Trial Ladder The Payne Trial Ladder, a competition lasting from February 26 to April 23. allowed students an opportunity to test their trial skills before student judges. The competition was split into two brackets. novice and senior, with novices competing in two person teams and seniors competing alone. The participants challenged one another to trials in order to scramble to the top. This experimental program has received funding from the El Paso law firm of Kemp. Smith. White. Duncan Hammond for next year, which will assure integration of the competition into the trial advocacy program of the Board of Advocates. LEFT: Ray Leach. Craig Olivier. Dick Price U8 Moot Court And Trial Competition Hildebrand Moot Court The final round of competition for the Spring Hildebrand contest was held on April 5. Ann Snell and Nancy Simonson argued against Douglas Little and Leland McKeeman before the Texas Supreme Court. The Court found in favor of the Little-McKeeman team. This year’s problem involved a defective tire. The key issues were products liability and the zone of danger. The problem was drafted by the Board of Advocates for use at the University of Texas School of Law but was adopted by many other law schools, including Baylor. M9 Client Counseling Team Competition was held on February 18.19.23 to select the UT Client Counseling Team. David Cowling and Doug Sandage went on to regional competition in Tulsa. Oklahoma on March 5-6. They placed second in the regional competition. The UT competition and team were sponsored by the El Paso firm of Grambling. Mounce. Deffe-bach, Sims. Hardie Galatzan. State Bar Team The final round to select the UT team for the State Junior Bar Moot Court Competition was held April 21. The team, pictured from left to right, is composed of Ron Franklin. Chris Scruggs, and Eric Samuelson. with Ronn Brazell as alternate. The team will compete in State competition to be held during the State Bar Convention this summer in Austin. First Year Moot Court Barbara McComas and Greg Hicks were the first place team in the final round of competition on March 10. The best brief award was won by Jeff Holmes and Elizabeth Dennis. Thirty-two two-member teams, selected for their abilities in legal research and writing, opposed each other in the five rounds of competition. Act I. a musical adaptation entitled MY FAIR LAWYER , saw Claude Marshal Hopper, the janitor, transformed into the power behind the Marshall Hopper Law School through the efforts of two inspired faculty members. Act II was a series of sketches, songs and special guest appearances. One of the most notable was the appearance of Bart Cox to announce the winner of the Bart Cox award. The final day of the Eighth Annual Page Keeton Law Week was celebrated with beer and tamales provided by the SBA and a lively basketball game. Profs Beat Women In a hard-fought contest resembling field hockey more than basketball, the faculty cagers edged the Law School women 34-33. The game developed into more than a duel between the teams, as the referee. Bart Cox winner Casey Donovan, and the faculty's enforcer” George Idi Amin Schatzki had an id-to-id confrontation. Bewildered by Donovan’s inventive foul calls. Schatzki protested, and the ref felled him with a vicious basketball handoff. He regained his composure only to be assessed a technical foul. Spearheaded by Dave “Loosey-ana Slim” Robertson, and Gary The Dean” Munneke. the faculty held off a stubborn counterattack by the women. The women, led by Becky and Beth Beaver, were unable to penetrate the faculty defense, but showed good outside shooting. Speakers Two of the guest speakers this spring were Secretary of State Mark White and Justice William Rehnquist. Mr. White addressed the students during the 1976 Page Keeton Law Week. Justice Rehnquist was the speaker for the ninth annual Will E. Orgain lecture.
