THE PEREGRINUS OF 1966 EDITOR: Ted Clark Chilcote BUSINESS MANAGER: Franklin Joseph Douthitt The Annual The University School 2 Publication Of Of Texas Of Law 3 The Tradition Of The Peregrinus The Latin word peregrinus” is an adjective meaning traveled from a foreign place.” It is pronounced with the ”u” short, and by accenting the long i”; that is, pair-ah-GRINE-us,” rhyming with minus.” The symbol of the Law School known as the Peregrinus, however, is pronounced in an entirely different manner which will be explained below. Much of the territory conquered by ancient Rome was allowed to retain the local substantive law. Roman citizens, on the other hand, were subject only to the law of Rome, regardless of where they went or with whom they dealt. Commerce sprang up between Romans and the territories creating serious legal problems. What body of law would apply to a contract between a Roman and a person of one of the territories? To deal with this difficulty, Rome sent traveling judges, Praetors Peregrinus,” on circuit tours through the territories. Their job was not to apply any formal body of law, but to see that justice was done in each case according to the dictates of conscience. This is one of the important roots of the law of Equity. W. S. Simpkins began teaching in the Law Department at the University of Texas in September 1899. He had been a Colonel in the Confederate Army, and had practiced law for several years in Dallas. His,main subject of instruction was Equity, a junior law course. One year later, in the autumn of 1900, junior law student Jim L. McCall made a lasting name for himself as one of the all-time great centers on the University football team. It is not surprising that, in the process, he was absent from a few of his Equity classes and missed Judge Simpkins’ explanation of the Praetors Peregrinus. In early December, 1900, in the basement of the east wing of the old Main Building, where the Law Department was then located, the Equity class was in session. Jim McCall was present, but probably apprehensive, for Judge Simpkins was conducting an oral quiz to review material covered in his fall lectures. In another part of the room, next to a blackboard, sat Russell R. Savage and Scott W. Key, both junior law students. Mr. McCall, what was the Peregrinus? asked Judge Simpkins. Judge, I don't know, unless it was some kind of an animal, replied McGill. A wave of laughter swept the class. With sudden inspiration, Russell Savage leaned over to Scott Key and whispered, I will draw a picture of it.” Savage had a natural talent for drawing. He found a piece of chalk and began deftly sketching on the blackboard the creature in his imagination. Scott Key kept watch on Judge Simpkins, who did not notice them. The completed drawing was about three feet long and twenty inches high. It depicted a four-legged animal with a piebald coat of short fur, and rather slender legs. Its tail, held proudly erect, was extremely bushy. It had a bird-like beak as long and narrow as a stork’s, but set with the conical teeth of an Archaeopteryx. There were no ears to be seen. A small crown was set on the back of its head where cars might have been. Its stance left no doubt that the creature was alert to some danger. Its beak was slightly open. Its back was arched, and one forefoot was held straight out in front. This foot wore a man’s high-top work shoe. One hind foot was laced into a boxing glove. The other two feet were bare, showing claws. The Peregrinus” was written under the drawing. This work of art remained on the blackboard for several days and was the subject of much joking in which the students used a variety of odd pronunciations. It was from this banter that the current usage descended. Today, when speaking of this creature, the word is almost universally sounded as pair-ah-grin-OOS;” that is, the i” of Peregrinus is short, while the u is long and is accented. This unorthodox pronunciation has mistakenly been attributed to Judge Simpkins; in reality, he always spoke the word in the correct Latin, even on that fateful day when the animal was born. Judge Simpkins saw this Peregrinus as symbolizing the administration of equity. The work shoe—he called it an Irish ditcher’s boot—shows that law will protect the least of mankind. The bare claws give warning that the greatest of mankind must fear its power. The arched back suggests it is ready to spring, just as the law is always ready to protect rights or prevent wrong. The sharp beak symbolizes the power of equity to penetrate the mysteries of the law, a power which must be developed by study. The bushy tail reminds us that equity brushes away the technicalities of the law and does justice on the merits. Early in the spring of 1901, the Junior Law Class adopted this Peregrinus as their emblem. Savage drew the creature on cloth and, with the help of his landladies and of Elmer Pope, cut out the drawing and sewed it onto, another piece of cloth of a different color, creating a banner. Its life was short, for in a few weeks a rival student group, either the Freshman Law Class or the Engineers, destroyed it. In 1902, the Peregrinus was being depicted with a high-top work shoe on each front foot, a boxing glove on each hind foot. It was thus shod when it made its first appearance in print, in the 1902 Cactus. The first papier-mache model of the Peregrinus was created in the fall of 1912. It is unknown exactly how many have been created and destroyed since. The Peregrinus which currently reigns over the Law School appeared about 1948. The upraised left front foot and the right hind foot each wear a cowboy boot emblazoned with the Texas Lone Star. The other two feet are bare, showing claws. The legs are somewhat thicker and shorter than on the original Peregrinus, and the tail is far less bushy. Brought out only for special occasions, the Peregrinus is kept safe in a secret location. Russell Savage practiced law in Corpus Christi for many years. On 24 February 1936, he wrote to Dean Ira Hildebrand, Someone has suggested to me that, as I am getting past middle age, it might be well to do something about the Peregrinus. Personally, I doubt very much that anyone but an engineer would have designs on the Peregrinus. Nevertheless, as the sole perpetrator of this monstrosity, I will be glad to do anything that you may suggest to fix the ownership where it belongs. The only thing that I can think of just at present is for me to convey whatever right I have in it to the University for the benefit of the Law Department, and then the Law Department could take out the necessary papers on it. I really am confused in whether it should be copyrighted, trademarked, or patented. Perhaps, being somewhat animal-like, it might be registered. I feel sure that the Junior Laws of this year will be able to work out the procedure. With best wishes, I am, Your friend, Russell Savage Although there is no record of it being officially adopted, the Peregrinus is now firmly rooted as the traditional symbol of the University of Texas School of Law. 5 FOREWORD As the 1966 edition of the Peregrin us takes its place on the shelves of graduates and students, it should be borne in mind that the book is more than a collection of pictures and names. I he Peregrinus is an indelible reflection of the people and activities which, during the year, have been blended with the past to form another chapter in the ever-growing history of the University of Texas School of Law. A scries of current personalities and activities has now become a chronicle. Many faces have passed into the shadows of the past; and many events would be on the verge of being lost to recollection, were it not for the Peregrinus reminding us of them. The book captures, if only in small measure, those things which have been the essence of a given year. The Peregrinus is a very special annual, being one of a few of its kind; and the School of Law is a very special institution. Because the annual represents not only students, but all the tangibles and intangibles which are the School of Law, no issue is taken and no view is expressed. The Peregrinus, then, is a mute reminder of that moment in time in which time and effort were expended in preparation for a career in law. A sincere effort has been made to produce a meaningful and significant link with the School of Law for the alumni and to chronicle the year for those who will be given another opportunity to make the most of a place in the School community. Elliott, Jr. Professor Of Law Dedication It is with great pleasure that the Society of the Peregrinus dedicates the 1966 Peregrines to Professor Frank W. Elliott, Jr. in recognition of his many contributions to the School of Law and to the students who comprise the academic community. Mr. Elliott’s work and legal career mirror stimulated effort and inspiration, as well as original thought and energy. As a student at the University of Texas School of Law, Mr. Elliott amassed academic honors and distinctions which include: membership in Phi Delta Phi Legal Fraternity, election to the Editorial Board of the Law Review in the office of Comment Editor, membership on the Honor Roll, election to the Chancellors, and selection for the Order of the Coif. After a short time with the practicing Bar, Mr. Elliott returned to the Faculty of the School of Law. His teaching efforts have been centered in the field of Procedure, in which he has manifested a great interest and facility. Mr. Elliott’s energy and ability arc clearly illustrated by the fact that, though a young member of the Faculty, he has attained professorial rank and has co-authored two casebooks on Texas procedure. In addition to his academic contributions, Mr. Elliott maintains an active extra-curricular schedule of participation in the School’s bowling league and work with the local Army Reserve Legal Section, as well as work with the various Faculty committees. Though the schedule be full, Mr. Elliott has always found time for personal contact with students through the various School activities. PAGE KEETON Dean Of The University Of Texas School Of Law Dean Keeton received his A.B. and LL.B. degrees from the University of Texas in 1931 and his S.J.D. from Harvard University in 1936. He has served as Assistant Professor of Law, 1932-1935; Associate Professor of Law, 1936-1939; and Assistant Dean, 1940-1942, at the University of Texas School of Law. Dean Keeton served as Chief Counsel, Petroleum Branch, Division Counsel, Fuel Division, and Price Executive of the Petroleum Branch of the O.P.A. from 1942-1945. Thereafter, he served as Dean of the University of Oklahoma School of Law from 1946-1949. He has been Dean at the University since 1949. Dean Keeton lectures Torts and conducts selected senior seminars. He has published numerous articles in many law reviews; is co-author of the Seavey, Keeton and Keeton Cases on Torts casebook; and edited Cases on Fraud and Mistake. During his tenure as Dean of the School of Law, improvement has been Dean Keeton's administrative touchstone. The physical plant, the faculty and staff, and the student body have grown without sacrificing standards of quality. Indeed, greater selectivity in admissions, stricter standards for appointment to the faculty, and improved teaching techniques and materials have become identified with the School’s growth. FULLERTON Assistant Dean And Director Of Continuing Legal Education For The School Of Law LEON GREEN Distinguished Professor Of Law Mr. Green holds a B.A. from Ouachita College, an M.A. from Yale University, and an LL.B. from the University of Texas. He has also received the LL.D. from Louisiana State University. Beginning as an Instructor in Law in 1915, he rose to the rank of Professor of Law in 1920 at the University. After practicing for six years, he became Dean, on leave, of the University of North Carolina School of Law; and during that time, he was named Professor at Yale University. He was Dean of Northwestern University School of Law for eighteen years. Mr. Green returned to the University as a Professor of Law. He has written many articles for legal periodicals, and his publications include: Rationale of Proximate Cause, Judge and Jury, Cases on Relations, The Judicial Process in Tort Cases, Traffic Victims, and My Philosophy of Law. EDWARD WELDON BAILEY Professor Of Law Albert Sidney Burleson Professorship Mr. Bailey began the practice of law in Dallas in 1928, after having received the B.A. and LL.B. degrees from the University of Texas. He became an Associate Professor in 1930 and has been a Professor since 1936. He received the S.J.D. degree from Harvard in 1942. Mr. Bailey assisted in drafting the Texas Business Corporations Act and is a member of the Texas Bar Committee on Revision of Corporation Law. Mr. Bailey lectures on a wide range of courses which includes: Trusts, Wills and Estates, Agency, and Commercial Law. 14 GUS M. HODGES Professor Of Law Hines H. Baker Professorship Mr. Hodges received his LL.B. from the School of Law in 1932. He had previously received the B.B.A. degree in 1930. He was admitted to the Bar in 1932 and practiced law in Dallas until 1940. In that year, he joined the faculty as an Associate Professor. He has lectured in Judicial Remedies, Trial Procedures and Pleading, and Appellate Procedure. He is the author of the standard w'ork, Special Issue Submission in Texas, which earned him the recognition as the foremost authority of that facet of Texas practice. He has served as a Commissioner on Uniform State Law. He co-authored the casebook, Texas Trial and Appellate Procedure. WILLIAM ORR HUIE Professor’Of Law Sylvan Lang Professorship Mr. Huie holds a B.A. from the Henderson State College, an LL.B. from the University of Texas, and an S.J.D. from Harvard. He was admitted to practice in 1935, joining the faculty as an Associate Professor in 1936. He became a Professor in 1946. Mr. Huie served as the Assistant Dean from 1946 to 1948. His publications include: Cases on Oil and Gas, Texas Cases on Marital Rights, Cases on Texas Land Limitations, Texas Public Lands, and Texas Supplement on Administration of Estates. Mr. Huie lectures on Oil and Gas, Marital Rights, Texas Land Titles, and Trusts. JERRE S. WILLIAMS Professor Of Law Rex G. Baker Professorship Mr. Williams received the A.B. from the University of Denver and the LL.B. from Columbia. From 1941 to 1942, he served as an Instructor of Law’ and Faculty Editor of the Iow'a Law Review at the University of Iowa. He served with the Army Air Corps from 1942 to 1946. In 1946, he came to the University as an Associate Professor, rising to Professor in 1950. Mr. Williams has served in the capacities of Attorney of the Office of Price Administration and Associate Director of the Study of Loyalty-Security Programs of the City of New’ York Bar Association. He has published Cases and Materials on Employees Rights, Labor Relations and the Law, and treatises on the structure of the legal system. 15 MILLARD H. RUUD Associate Dean Professor Of Law Mr. Ruud received his B. S. I. and LL.B. degrees from the University of Minnesota, in 1942 and 1947, respectively. He came to the University of Texas in 1948, as an Associate Professor of Law, after having served in that capacity at the University of Kansas in 1947 and 1948. He was made a Professor of Law in 1950. Mr. Ruud served as Assistant Executive Director of the Texas Legislative Council from 1950 to 1952. He is General Editor and co-author of the Texas Study of the Uniform Commercial Code. Mr. Ruud teaches Legislation, Commercial Law and Local Government. MARION K. WOODWARD Professor Of Law Mr. Woodward received his B.A. degree from the University of Texas in 1933 and his M.A. from West Texas State College in 1940. He returned to the University for his LL.B. which was conferred in 1943. After World War II, he was in private practice in Amarillo. He joined the law faculty in 1946. Mr. Woodward was made a Professor of Law in 1950. In that same year, he was honored as a Sterling Fellow at Yale University. Mr. Woodward has also served in the capacities of acting Dean, Assistant and Associate Dean of the University of Texas School of Law. He lectures in Mortgages, Texas Land Titles, Fiduciary Administration, and Oil and Gas. Mr. Woodward is a coauthor of the Oil and Gas casebook. CARL H. FULDA Professor Of Law Hugh Lamar Stone Chair Mr. Fulda was awarded a J.V.D. in 1931 from the University of Freiburg and an LL.B. from Yale University in 1938. From 1946 to 1954, Mr. Fulda was a Professor of Law at Rutgers University School of Law. In 1954, he joined the faculty of Ohio State University College of Law. He came to the University in 1964. Mr. Fulda is the author of many articles in legal periodicals. He is on the Board of Editors of the American Journal of Comparative Law and the Journal of International Law and Commerce. During 1959-1960, he was a Ford Foundation Fellow. Mr. Fulda lectures in Government Regulation, Administrative Law, and International Transactions and Transportation and teaches a seminar in World Trade. 16 CORWIN W. JOHNSON Professor Of Law Mr. Johnson received his A.B. from the University of Iowa in 1939 and his J.D. from Iowa in 1941. In 1942 he became a Special Agent for the Federal Bureau of Investigation. He joined the Faculty of the University of Iowa in 1946 as an Instructor. In 1941 and 1947, he was a Sterling Fellow at Yale University. Mr. Johnson came to the Texas Faculty-in 1947, and has been a Professor of Law since 1954. Mr. Johnson is a co-author of Cases and Materials on Property, written in collaboration with Messrs. Cribbett and Fritz. He teaches Property, Water Law, Texas Land Titles, and Land Use Planning. JOHN F. SUTTON Professor Of Law Mr. Sutton was in private practice in San Antonio from 1941-1957. He received his LL.B. with honors from the University of Texas in 1941. From 1941-1945, he was with the Federal Bureau of Investigation in Washington, D.C. He is a member of the International Association of Insurance Counsel and the Legal Committee of the Interstate Oil Compact Committee. Mr. Sutton is presently rewriting the Canons of Ethics as Reporter for the Special Committee on Evaluation of Ethical Standards of the American Bar Association. He came to the University to teach in 1957 and lectures in Torts, Legal Profession, Oil and Gas, and Evidence. KEITH E. MORRISON Professor Of Law Mr. Morrison attended the University of Kansas and received his B.A. in 1931. He received his M.S. from the University of Wyoming in 1939. From 1939 to 1941, he was an economist for the Agricultural Extension Service of the University of Wyoming. He completed his legal training in 1948 at Yale, coming to the University as an Associate Professor of Law. He has been a Professor since 1951. Mr. Morrison teaches Constitutional Law, Federal Taxation, and Estate and Gift Taxation. 17 ALBERT P. JONES Professor Of Law Mr. Jones received his B.A., M.A., and LL.B. from the University of Texas with highest honors. He engaged in civil practice in Houston from 1930 to 1962, and is past-President of the Houston and Texas Bar Associations, and a member of the Supreme Court of Texas Advisory Committee on Rules of Civil Procedure. He is also a member of the American Bar Association. He is co-author of Texas Trial and Appellate Procedure with Messrs. Frank Elliott and Gus Hodges. Mr. Jones lectures in Procedure III, Procedure II, Federal Courts, and Legal Profession. JOSEPH P. WITHERSPOON Professor Of Law Mr. Witherspoon received his A.B. degree from the University of Chicago in 1936, and his LL.B. in 1948, from the University of Texas. The degree of S.J.D. was conferred upon Mr. Witherspoon by Harvard University in 1961. He joined the Texas Law Faculty in 1948 as Assistant Professor, becoming Professor of Law in 1955. Mr. Witherspoon was Consultant to the United States Commission on Civil Rights in 1964. He is the author of Cases and Materials in Antitrust Law. Mr. Witherspoon lectures on Administrative Law, Antitrust Law, Constitutional Law, Jurisprudence and Legal Process. PARKER C. FIELDER Professor Of Law W. H. Francis Professorship Mr. Fielder received his B.S. degree at Northwestern University in 1941. He received his LL.B. at the University of Texas in 1948, and began teaching immediately upon graduating. Mr. Fielder served as an Associate Professor from 1948 to 1953, when he moved to Midland, to go into private practice. Mr. Fielder returned to the Law School in 1961, and became the William H. Francis, Jr., Professor of Law. He lectures in Business Associations I and II, Oil and Gas Taxation, Federal Taxation and Estate and Gift Taxation. During 1964-1965 Mr. Fielder was a Visiting Professor at the University of Pennsylvania. 18 J- HENRY WILKINSON Professor Of Law Mr. Wilkinson received his B.S. degree from the University of South Carolina in 1934, and his LL.B., with honors, from the University of Texas in 1949-He was an accountant after, he graduated from South Carolina until 1937, when he became an Agent for the Internal Revenue Service. He served in the Navy from 1942 to 1945, being honorably discharged as a Lt. Commander. He first joined the Law Faculty in 1950, as an Assistant Professor of Law. He then left the Law School for private practice in Midland, returning in 1957 as a Professor of Law. Mr. Wilkinson is a member of the Permanent Tax Council, and has lectured several times at the Annual Tax Conference sponsored by the University of Texas School of Law. Mr. Wilkinson lectures in Federal Estate and Gift Taxation, Oil and Gas Tax Law, Federal Income Tax Law, Tax Seminar and Legal Accounting. Mr. Wilkinson was a 1965 Peregrinus dedicatee. WILLIAM F. FRITZ Professor Of Law Mr. Fritz received his B.A. degree and his M.A. degree from the University of Texas, the latter having been awarded in 1938. Upon completion of his law studies in 1946, Mr. Fritz began his teaching career at the University of Texas Law School. During 1949 he was a Sterling Fellow at Yale University School of Law. Mr. Fritz was made Professor of Law at Texas in 1956, having previously been both Assistant and Associate Professor of Law’. His subjects are Marital Rights, Property and Damages. Mr. Fritz co-authored the casebook, Cases and Materials on Property, with Messrs, Corwin Johnson and John Cribbett. E. ERNEST GOLDSTEIN Professor Of Law Mr. Goldstein received his A.B. in 1939 from Amherst College, and his LL.B. from Georgetown University in 1947. He then attended Wisconsin University School of Law and obtained his S.J.D. in 1956. He served w'ith the Justice Department from 1947 to 1949, and with the War Claims Division from 1949 to 1951. He held other government posts as Assistant Counsel, Special Senate Crime Committee in 1951, General Counsel Monopoly Sub-Committee of the House Committee on the Judiciary in 1951 and 1952, and finally as United States Representative at the OEEC in Paris from 1952 to 1954. Mr. Goldstein came to the University of Texas School of Law' in 1955 as an Associate Professor. He was promoted to Professor in 1958. His subjects arc: Government Regulation, International Law, Common Market Seminar and Patent, Trademark, and Copyright Law-. Mr. Goldstein is a member of the American Society of International Law and the Texas and District of Columbia Bars. 19 CHARLES A. WRIGHT Professor Of Law Charles T. McCormick Professorship Mr. Wright received his A.B. degree from Wesleyan University in 1947, and his LL.B. from Yale University in 1949. In 1950. he was an Assistant Professor at Minnesota University, becoming an Associate Professor in 1953. He joined the Texas Faculty in 1955. Mr. Wright is a member of the United States Supreme Court Advisory Committee on Civil Procedure. He is the author of Wright's Minnesota Rules. Cases on Remedies and several books on Federal Procedure. Mr. Wright teaches Federal Procedure, Labor Relations, Constitutional Law and Remedies. PIERRE R. LOISEAUX Professor Of Law Mr. Loiseaux took his LL.B. at Boston University in 1950, and in 1951, he received his LL.M. at the New York University School of Law. While at New York University, he was a Teaching Fellow. Before coming to the University of Texas, Mr. Loiseaux was an Assistant Professor of Law at the University of Arkansas, and an Associate Professor of Law at Emory University. He joined our faculty in 1957, and since then, he has lectured on Creditors Rights. Labor Law. Fraud and Mistake, and Contracts. Mr. Loiseaux is a member of the American. Arbitration Association Panel of Arbitrators, and the Labor Law Group Trust. E. WAYNE THODE Professor Of Law Mr. Thode received his B.S. degree from the University of Illinois in 1943, his LL.B. from the University of Texas in 1950, and his S.J.D. in 1964, from Harvard. He was Briefing Attorney for the Supreme Court of Texas from 1950 to 1951, and was Assistant Attorney General of Texas in 1951 and 1952. Ending three years of private practice in 1955, Mr. Thode joined the Law Faculty as an Associate Professor, becoming a Professor of Law in 1959- Mr. Thode lectures in Procedure II, Torts, and Injuries to Relations. LEON LEBOWITZ Professor Of Law Mr. Lebowitz received his A.B. from Baylor University in 1940. his LL.B. in 1943 (Baylor), and his LL.M. from New York University in 1952. From 1946 to 1948, he was an Assistant Professor and Law Librarian at Baylor University Law School. BUTTE Professor Of Law Mr. Butte received his B.A. degree from the University of Texas in 1927. and his LL.B. from Yale University in 1931. In addition, Mr. Butte holds a Dr. of Political Sciences from the University of Central Venezuela. Mr. Butte has practiced law in numerous Latin American countries, and is a member of the American Society of International Law. His courses at the University arc Conflicts and Civil Law. FRANK W. ELLIOTT, JR. Professor Of Law Mr. Elliot received his B.A. degree in 1951, and his LL.B. in 1957. both from the University of Texas. Subsequent to graduation Mr. Elliot worked in the Attorney General’s office, and later clerked for the Supreme Court of Texas. He teaches Introduction, Procedure II and III, and Remedies. Mr. Elliot co-authored the casebook, Texas Trial and Appellate Procedure, with Messrs. Gus Hodges and Albert Jones. 21 RUSSELL WEINTRAUB Professor Of Law Mr. Weintraub received his B.A. degree from New York University in 1950 and his LL.B. degree from Harvard Law School in 1953. He was a Teaching Fellow at Harvard from 1955 to 1957 and a Professor of Law at the University of Iowa from 1957 to 1965. In 1965 he was a Visiting Professor of Law at the University of Michigan. In addition to a number of published articles, Mr. Weintraub is the co-author of The Iowa Law of Workmen’s Compensation and of the annual supplements in i960 and 1961 to Moore’s Federal Practice. Mr. Weintraub teaches Conflicts and Contracts. HARRY K. WRIGHT Associate Professor Of Law Mr. Wright received his B.S. degree from Georgetown University, School of Foreign Service, in 1949. He then attended the University of Texas School of Law and received his LL.B., with honors, in 1952. Mr. Wright was Editor in Chief of the Texas Law Review. Beginning in 1952 as a Lieutenant in the Judge Advocate General’s Corps of the United States Army, Mr. Wright was released from active duty in 1954. From then until 1962, Mr. Wright was in private practice in Houston and Mexico City, D.F. Mr. Wright teaches Agency, Civil Law, Conflict of Laws and a seminar in International Transactions. ERNEST E. SMITH Associate Professor Of Law Mr. Smith took his B.A. degree at Southern Methodist University in 1958, and his LL.B. from Harvard University in 1962. During 1962 and 1963, Mr. Smith served as clerk to Judge Wisdom of the Fifth Circuit Court of Appeals in New Orleans. He joined the Texas faculty in the Fall of 1963. Mr. Smith lectures in Property, Agency, Trusts and Marital Rights. Mr. Smith is the recipient of the 1966 Teaching Excellence Award. 22 FRED COHEN Associate Professor Of Law Mr. Cohen holds B.S. and LL.B. degrees from Temple University. He received his LL.M. in 1961, from Yale University. He was an Assistant Professor of Law at Denver University from 1961 to 1963, and became a permanent member of the Texas faculty in 1963. Mr. Cohen lectures in Constitutional Law, Criminal Law, Criminal Procedure and Criminal Correction. Mr. Cohen has been named the faculty consultant to The Southwest Center for Law and the Behavioral Sciences. STANLEY M. JOHANSON Associate Professor Of Law Mr. Johanson received his B.S. at Yale University in 1955. He took his LL.B. from the University’ of Washington in 1958, and was then admitted to the Washington Bar. Mr. Johanson served as a Teaching Fellow at Harvard University from 1961 to 1963, and received his LL.M. from Harvard in 1963. He joined the University' of Texas Law Faculty in 1963 as an Associate Professor. Mr. Johanson teaches Property-, Wills and Estates and Government Contract Law. He is a member of the American Bar Association and the Federal and Washington Bars. ROBERT W. HAMILTON Associate Professor Of Law Mr. Hamilton received his B.A. degree from Swarthmore College in 1952, and in 1955 obtained a J.D. from the University of Chicago School of Law. He served as Law Clerk to Justice Clark of the United States Supreme Court from 1955-56. Mr. Hamilton was admitted to the District of Columbia Bar in 1956. He left private practice in Washington, D.C., to join the Texas Law Faculty in 1964. Mr. Hamilton lectures in Contracts, Creditor’s Rights and Business Associations. 23 RICHARD V. BARNDT Associate Professor Of Law Mr. Barndt holds B.S.L. and LL.B. degrees from the University of Utah. He has been Assistant Professor at the University of Montana, the University of Houston, and the University of Washington. He came to the University of Texas in 1964 as Associate Professor. He teaches Contracts, Legislation, and Language and Logic in The Law. W. W. GIBSON Associate Professor Of Law Mr. Gibson received his B.A. degree in 1954 and his LL.B. degree in 1956, both from the University of Texas. He is a member of the Amarillo Bar Association, the State Bar of Texas and the American Bar Association. Mr. Gibson was a partner in the Amarillo law firm of Gibson, Ochsner, Harlan, Kinney Morris from 1956 to 1965. Legal Profession and Wills and Estates are the courses which Mr. Gibson teaches. ALLEN E. SMITH Assistant Professor Of Law Mr. Smith received his B.A. from the University of Texas in I960 and his LL.B. from Texas Law School in 1961. He was admitted to the Texas Bar in 1961. Prior to his return to Texas as an Assistant Professor of Law in 1964, Mr. Smith served as a law clerk for Judge Hutcheson of the United States Circuit Court of Appeals, 5th Circuit. He was also in private practice in Beaumont with Orgain, Bell and Tucker from 1962 to 1964. Mr. Smith is currently teaching Contracts, Constitutional Law and the Judicial Administration Seminar. 24 JOEL J. FINER Assistant Professor Of Law Mr. Finer received his B.B.A. from City College of New York in 1959. In 1963 he was awarded both a M.A. and a LL.B. from Yale University. Mr. Finer joined the Texas Law Faculty in 1964, after having served as law clerk to U.S. Circuit Judge George T. Washington. Criminal Law, Constitutional Law, and Comparative Constitutional Law arc the courses Mr. Finer teaches. PAUL F. ROTHSTEIN Assistant Professor Of Law Mr. Rothstcin received his B.S.L. from Northwestern in 1959. and his LL.B. also from Northwestern, in 1961. He studied at Oxford University, England, from 1961 to 1963, as a Fulbright Scholar. He was admitted to the Illinois Bar in 1961. Prior to coming to Texas, he taught at the University of Michigan and the University of Florida. Mr. Rothstcin is the author of The Attack on Market Security in the United Kingdom and the United States. Mr. Rothstcin came to the University of Texas in 1964, and is currently lecturing in Criminal Law, Evidence and Conflicts. MARSHALL SHAPO Assistant Professor Of Law Mr. Shapo holds the A.B. and LL.B. degrees from the University of Miami and the A.M. and S.J.D. degrees from Harvard. Mr. Shapo was a student instructor in Research Writing in 1963 and 1964. He teaches Injuries to Relations, Torts, and Business Associations. 25 GEORGE SCHATZKI Assistant Professor Of Law Mr. Schatzki received his A.B., LL.B., and LL.M. degrees from Harvard in 1955, 1958 and 1965 respectively. He was Attorney for the National Labor Relations Board from 1958-1960 and practiced with the Dallas firm of Mullinax, Wells, Morris and Mauzy from I960 to 1963. Mr. Schatzki lectured classes at Southern University Law School, 1961 to 1963, and has been a Teaching Fellow at Harvard Law School, 1963 to 1965. He is a member of the Massachusetts and Texas Bar Associations. Mr. Schatzki teaches Constitutional Law and Labor Relations. COLONEL LEO. G. BLACKSTOCK Lecturer In Law Col. Blackstock holds B.A., M.B.A. and LL.B. degrees from the University of Texas. He was admitted to practice in Texas in 1933. From 1937 to 1938, he was Chief Examiner for the Gas Utilities Division of the Railroad Commission. He has been a colonel in the United States Army since 19-46, and was Chief of the Prosecution Division, Legal Section, of the General Headquarters in Tokyo from 1945 to 1948. Col. Blackstock has been Visiting Professor of Law at Texas since 1953, and Professor of Business Law at the main University since 1927. Col. Blackstock teaches Military Law. R. DEAN MOORHEAD Lecturer In Law Mr. Moorhead received his A.B. degree from the University of Kansas in 1938, and his LL.B. from Columbia in 1941. He was admitted to practice before the Texas and Federal Bars in 1942, and served as Assistant Attorney General of Texas from 1942 to 1945. Mr. Moorhead was on the faculty of the Law School in 1943 and 1944, and again in 1946 and 1947. He has been on the Faculty of the College of Business Administration. Mr. Moorhead lectures courses in Contracts and conducts a seminar in Fiduciary Administration. 26 FRANK J. MALONEY Lecturer In Law Mr. Maloney received his B.A. in 1954 and his LL.B. in 1956 from the University of Texas. He is a member of the Texas State Bar Association, the American Bar Association, the Travis County Bar Association, and the Austin Junior Bar Conference. Mr. Maloney has served as First Assistant District Attorney of Travis County and as Chief of Law Enforcement Division for the Attorney General of Texas. He has been admitted to practice before the Supreme Court of the United States and established the Austin law firm of Procter-Maloncy Fullerton in 1962, of which he is currently a practicing member. Mr. Maloney lectures on Criminal Law. TOM B. BLACK Lecturer In Law Mr. Black attended the University of Texas, receiving his B.A. degree in 1949 and his LL.B. degree in 1952. He served as Assistant Attorney General of Texas from 1952 to 1955 and since that time has been a member of the Austin law firm of Stayton Black. Mr. Black is a member of the Texas Bar Association, the Travis County Bar Association and the American Arbitration Association. He lectures courses in Business Associations and Evidence. SAM LANHAM Lecturer In Law Mr. Lanham received his B.A. degree in 1953 and his LL.B. degree in 1955, both from Baylor University. He was a practicing attorney with the Waco law firm of Richey, Shccly, Tceling Cureton from 1955 to 1964 when he entered Austin Presbyterian Theological Seminary to work toward the B.D. degree. Mr. Lanham is a member of both the American Bar Association and.the Texas Bar Association. He lectures courses in Introduction to Legal Processes, Insurance and Eminent Domain. 27 WOODROW W. PATTERSON Director Of The Legal Aid Clinic Mr. Patterson received his LL.B. from the University of Texas in 1936. Since 1942, he has been Director of the Legal Aid Clinic. He was admitted to practice before the State Bar in 1936, and since 1941, he has been a partner of the firm of Patterson and Patterson in Austin. From 1937 until 1941, he was Assistant District Attorney for Travis County. Mr. Patterson also teaches Office Practice. HELEN HARGRAVE Associate Professor Of Law Miss Hargrave received her LL.B. and was admitted to practice in 1936. In 1930, she became Assistant Law Librarian at the University of Texas. She is a past president of the American Association of Law Librarians and is a member of the State Bar of Texas. Having served as Law Librarian since 1940, Miss Hargrave is in semi-retirement this year. 28 ROY MERSKY Professor Of Law Director Of Research Mr. Mersky holds the B.S., M.S.L.S., and LL.B. degrees. The governing body of the SBA is the Board of Governors, which meets bi-monthly and is composed of nineteen elected members and one appointed member. The SBA endeavors to carry out its objectives and contribute to the professional education of the law student by sponsoring programs which arc mainly co-curricular in nature. The co-curricular programming sponsored and supervised by the SBA, through its Board of Governors, falls into three main categories: service, professional, and social. Service Programming provides such needed and convenient services for law students as the Book Exchange, Blue Book Program which is below the going retail costs, Blood Fund, supervision of student lounges and study halls, free telephone service, organization and individual mail sendee, Humor Board, SBA Bulletin Boards, orientation programs, Library, Building and Grounds and Texas Union Relations Committees, and many others as occasions arise. Professional Programming includes the Film Forum, speaker programs. First Year examination orientation. Bar Review lectures, SBA Travis County Bar Lecture Series, Texas Law Forum, Effective Legal Reading Program, Teaching Excellence Award, Pre-Law Club sponsorship, Studcnt Faculty Relations Committee. The national membership numbers over 11,000. The organization provides benefits and sen-ices to individuals, student bars, and to schools. The University of Texas School of Law is a member of the ALSA 13th Circuit which includes twelve schools in Texas, Louisiana, and Arkansas. The University has been an active participant in the program since its inception. The school received an award as one of the three outstanding Student Bars in the nation in 1963. The membership numbers over 500. John Compere has represented the School as the National Vice President for the 13th Circuit and was presented the ALSA Gold Key Award for his leadership. James Buster” Brown is the school ALSA representative and Publicity Director for the Circuit. Frank Feuillc is a member of the ALSA Techno-Legal Committee and has gained recognition for his legal research in the furtherance of the committee’s work. I?9 The Book Exchange is provided during the fall, spring, and summer registration periods for the economic welfare of the student body. The exchange benefits both the seller and the buyer in that books to be sold arc offered at more than the retail re-purchase price, yet below the retail selling price. The SBA operates the exchange as a free service to the students, and a large traffic in used books is handled by the co-chairmen each registration. The committee is a sounding board for complaints, suggestions, and recommendations, as well as a bi-partisan forum for airing problems of mutual concern and for exchanging criticism. The committee is also charged with appointing the Honor Tribunal from the nominated slate of candidates prepared by the Honor Council. The Election Commission is composed of seven appointed members. The commission is charged with the responsibility for conducting all Law School elections, including setting filing dates and election dates, providing candidates with notice of the polling, maintaining the physical polls, tabulating and publishing the results and providing a forum for hearing elections contests. The commission has just completed a revision of the Election Code to provide a more comprehensive and lucid statement of policy and procedure. The Effective Legal Reading Program represents a successful new innovation to aid students in academic preparation. The program is an adaptation of the popular speed-reading programs and theories to the materials and needs of the legal profession. Certain organizational weaknesses and changed circumstances warranted the year-long study, made in an effort to maintain the popular and desired facets of a freshman oriented extracurricular program. After the completion of the study, the program will be incorporated with the Legal Research sections to provide both social and professional opportunities to freshmen. It is that opportunity' for the student body, without distinctions drawn on classification or fraternal lines, to enjoy a respite from the academic schedule of the year. The dance is utilized as a vehicle for the presentation of the Portia of the School. The holiday season is that time of year when the SBA, recognizing a professional responsibility to the public, undertakes a drive for the benefit of the patients of the Austin State Hospital. The proceeds of the annual drive are applied to securing benefits for three wards at the hospital. Law Day is designed to create a deeper understanding and respect for the legal profession. The format used to implement such a purpose has, in itself, become a tradition. Law Day begins with the final arguments of the Hildebrand Moot Court Competition, followed by a barbeque picnic served on the grounds at noon. The afternoon session includes the presentation of special awards, followed by the addresses of the featured speakers. Law Day ends on a social note. Assault and Flatter)’ is a school production which spoofs an otherwise serious year of academic preparation, school administration, procedures, and personalities. Awards are given for the best group and individual participation. The theme of the 1966 Law Day centers around the modern social, economic, and political problems confronting the legal profession which require the cooperative interworking and research of many disciplines. 133 Mr. Graves has probably served the School of Law in a variety of ways for as long a period as any living man. Moreover, throughout this long period of service he has always I een a loyal and devoted alumnus, regardless of the inadequacies of the program or actions of the faculty and the administration that he might have felt to be mistakes. Mr. Graves is a native Texan, born in Sequin in 1885. He holds a B.S. from Southwestern and an LL.B. from the University of Texas. He is recognized as a lead in the cause of improving the administration of justice. He is a member of the American Bar Association, the American Law Institute, the International Law Association, an original Fellow of the American Bar Foundation. Mr. Graves has been Treasurer of the Texas Law Review since its incorporation in 1922, being one of the original incorporators. His many years of devotion to the School of Law, manifested in his generous gifts of time, talent, and resources, are capped by his recent creation of a fund for the improvement of the Law Libra ry. Mr. Graves has been honored by the School of Law on several occasions. He was elected to the Order of the Coif by the faculty. His outstanding service to the Law Review was recognized at the 1965 Law Review Banquet. As Dedicatee of the Fourteenth University of Texas Law Day, Ireland Graves is again given the thanks of a grateful and appreciative student body. Dedicatee Ireland Graves Featured Speaker Geoffrey C. Hazard, Jr. The Featured Speaker of the Fourteenth Law Day is Mr. Geoffrey C. Hazard, Jr., Professor of Law at the University of Chicago School of Law and Administrator. American Bar Foundation. He is recognized for his writings on pleadings and procedure and on research in civil procedure. Mr. Hazard holds a B.A. from Swarthmore and an LL.B. from Columbia. He has been engaged in private practice in California, in public service, and in teaching at Berkeley. Chicago, and Michigan. His subjects include: Civil Procedure, Legal Process, Introduction to Law. Trial Practice, Legal History, Equity, Constitutional Law, and Federal Jurisdiction. In 1964 Mr. Hazard was chosen by the Board of Directors of the American Bar Foundation to direct and supervise its research program. His work as Administrator has put him into close proximity with the special problems which confront the modern Bar. In the context of modern legal education one of the best ways to study cases is moot court participation. The sheer bulk of material in most law courses precludes a close analysis of cases beyond their significance as legal precedents. It is hard enough to learn the law, much less how it got that way or what it might have been. Although the case method of instruction aims at emphasizing facts and strategems—the heart of litigation—as well as case holdings, practical law students know that these arc deemed secondary. The Moot Court Program has grown each year due to the efforts of the Faculty and the Austin Bar. Participants arc given problems which represent the crux of an issue in litigation and are charged with the preparation and presentation of one side of the case. During the 1965-66 year, over 200 students represented these fictionalized clients with very real legal problems. The Hildebrand Competition, the oldest and largest competition for Texas law students, has both fall and spring rounds which together command by far the greatest amount of judging time and energy. Any student may enter after he has taken the required freshman courses. After the fall eliminations, thirteen teams are qualified to participate in the spring rounds. Thus, the final round heard on Law Day represents a full year's efforts. The case to be argued on Law Day, Paul Prudence v. The City of DurneyviUe, is a tort action brought by the plaintiff to recover damages for injur}' sustained in an intersection collision with a city firetruck. Governmental immunity will be the heart of the case. In acknowledgement of the valuable academic and practical experience offered by moot court competition, the faculty of the law school voted this year to permit graduation with honors to those students in the top fifteen percent of their class and who have excelled in moot court competition and participation. Past Chancellor William H. Thomas of Cleveland, Ohio, who was the national installing officer fifty years ago, and many of the original founding members, returned to Austin to help Sam Houston Senate commemorate its anniversary. The main event of the occasion was a banquet held at the Driskill Hotel where Governor John B. Con-nally made the principal address. Governor Connally is a former Dean of the chapter. The banquet was hosted by the student members of the senate, and was attended by many of the national officers of the fraternity, many state and national political figures, and attorneys from the entire United States. The group, originally known as the LLB Fraternity, has been granted affiliation with an established national legal fraternity. Currently, membership is limited to male students of at least twenty-six years of age not otherwise affiliated with other organizations. The faculty advisor is Mr. E. E. Kappa Beta Pi, international legal sorority, was organized in 1908 at the Chicago-Kcnt School in Illinois, and now boasts sixty-four active chapters in six countries. Eta Chapter, installed at Texas in 1916 as the sorority’s seventh United States chapter, has recently been reactivated with an installation ceremony and dinner. Requirements for membership include having completed at least seven hours of legal work with a weighted average of at least 70. Activities of the group this year included a formal initiation ceremony at the home of Dean and Mrs. Keeton, a fall luncheon at the Villa Capri, and a Christmas Charity project. The organization partakes of many of the attributes of the undergraduate social fraternity, without restrictive ritual and regulation. The objective, simply stated, is to provide a means for the student to meet girls within a framework of a planned social calendar. This function is particularly advantageous for those students who are not University undergraduates and whose social contacts at the University must begin with the registration for law work. The parties are best characterized as mixers, with such women's organizations as: ADPi, Alpha Phi, AChiO, and Gamma Phi Beta. Four functions arc usually planned each semester; three match parties and one for which the member must provide his own date; BYOD, as it were. 11k- organization normally numbers sixty full members and thirty associate members. Full membership carries the benefits of a date service, while associate membership is accorded only the hospitality of the planned events. Nominal dues are assessed each year to finance the functions. The Law Bachelors will be remembered as that group responsible for the colorful and attractive posters which adorned the halls. While such is at best a mixed distinction, the outward manifestation of a poster does sene to express the personality' of the group, a mature recognition of the need to temper study with social contact. A need for the law wife to have something to provide a common denominator for contacts with the Bar—and a student husband—is recognized by the group. The Society, organized, chartered, and incorporated under the laws of the State of Texas, is a non-profit organization pledged to serve the School of Law and its student body. The Baird of Governors serves as the Board of Directors and has immediate responsibility for editorial and financial policies and procedures. The Society operates under by-laws which incorporate both its own particular regulations and those of the Student Bar Association. Faculty and Staff supervision is provided in the persons of Professor C. A. Wright and Dean T. J. Gibson. The editor, an elected officer of the Student Bar, is allowed wide discretion in the selection of the staff, only the Business'Manager being subject to Board approval. The Forum publishes articles written by authorities on international law and has world-wide distribution. Casenotes, comments, and book reviews written by students of the School of Law arc an equally important part of each issue. Those students who fulfill the Forum's writing requirements become members of the Casenote and Comment Staff and arc eligible for election to the Board of Editors. The Forum is one of three student-edited international law journals currently listed in the Index to Legal Periodicals. 159 International Law Forum The Texas Law Review, founded in 1921, is a periodical published seven times yearly under the supervision of student editors. Each issue consists of articles written by prominent legal scholars, observations by attorneys on subjects of current interest, comments prepared by student editors and candidates for election to the editorial board, cascnotes and statute notes written by candidates, and reviews of recent books of legal significance. The Review is intended to serve as a forum for analysis, explanation, and criticism of law, and as a research tool for attorneys and students. One of the functions of the Review is to help train students in the art of legal research and writing. Substantially all editing, solicitation of articles, and a considerable portion of the writing for the Review is done by Editor In Chief students. The student editors also supervise the writing of comments, case- notes, and statute notes by candidates. The candidates arc chosen from the P. DEXTER PEACOCK top fifty students scholastically in the first-year class. After contributing a specified amount of writing and aiding the editorial staff in the preparation of materials for publication, candidates are eligible for election as officers and editors of the Review. Eligibility for many of the honors conferred in the law school, such as Chancellors and Order of the Coif, depend upon, and graduation with honors may be obtained by, outstanding quality of work contributed to the Review. The Moot Court Board has traditionally administered the Hildebrand Moot Court Competition and coordinated the efforts of Texas Law School teams involved in the National, State Bar, and International Law Moot Court competitions. In addition, this year the Board has furnished Teaching Quizmasters to lead sections in the new course, Legal Research and Writing, as well as Brief Writing and Oral Advocacy. This year, Texas Law School teams have been singularly successful in all competitions: the National and State Bar teams swept all honors in their competitions and the International Law Team reached the semi-finals in its national competition. In addition, this year the faculty granted students in the top 15% of their classes the opportunity to be graduated with honors through Moot Court participation. E. Goldstein to discuss issues of International Law. The same year, the Society was voted membership in the Association of Student International Law Societies. Six months after its beginning, student Advocates from the Society defeated teams from Columbia, Howard, and the University of Pittsburgh to win the 1964 International Law Moot Tribunal Competition. In 1965, the Society team won the regional competition. In addition to the Moot Tribunal program, the Society participates in the planning and staging of Annual Regional Meetings of the American Society of International Law. Other programs are monthly meetings with speakers, a job placement service, and a fellowship and exchange information bureau. Origin: The Association was organized in the spring of 1965 by a group of students concerned about the general apathy of law students toward the criminal process and about the low status of the criminal bar. Purpose: The Association states as its purposes: 1. To increase among University of Texas students of law, the public, and the Bar, interest in and understanding of criminal law and criminal behavior. 2. To inform those students desirous of pursuing careers or of practicing criminal law' either as prosecutors or defenders of the opportunities available to them in this field of law'. Method: The Association is a study-action group. This includes monthly dinner-lecture meetings, and extracurricular action projects. The lectures are designed to supplement classroom experience, and the projects endeavor to expose law- students to areas of the law in which traditionally the legal profession in general has not been very active. Projects in which students currently are involved are: 1. Field trips to correctional institutions. 2. Screening mail from prisoners to determine whether constitutional issues arc raised. 3. Observing police practices by accompanying police in patrol cars to become familiar with law enforcement problems. 4. Representing juveniles in Juvenile Court under appointment by the Court to determine the role of the attorney in the juvenile process. Evaluation: The Association is a novel undertaking at the University of Texas School of Law, and is too young to evaluate its successes and failures in terms of functional importance to the School, but it is genuinely hoped that the ideas and enthusiasm which inspired its inception will be continued in order to strengthen the criminal law- curriculum at the School, and to strengthen the criminal bar in the State. 167 Criminal Law Society Civil Liberties Research Council The Civil Liberties Research Council provides students at the University of Texas School of Law with the opportunity to aid in the cause of civil liberties in a way particularly suited to their training as law students. Students are engaged in rcsearchinc questions pertaining to civil liberties for attorneys and organizations who seek the aid of the Council. Examples of current projects include: preparing a brief for the Texas Civil Liberties Union on a case involving the competency of the appointed trial counsel, review of the letters of prisoners, and the preparation of an article for the Texas Bar Journal which will describe the various sendees available to Texas practitioners at the School of Law. The Civil Liberties Research Council hopes to expand its efforts and to make itself available for worthwhile civil liberties projects. The Law Class of 1966 has recently organized a Twenty-fifth Reunion Fund program designed to provide the Law School with a substantial gift in 1991. Each member of the Class has been asked to pledge a minimum of ten dollars per year over the next twenty-five years. These contributions will be invested in the United Science Mutual Fund on a reinvestment basis whereby all dividends and capital gains distributions arc used to buy more shares of the fund and thus enhance the Class gift. At this point, approximately $1300 per annum has been pledged and it is hoped that the spring drive to sign up contributors will double the amount. The fund which is the first of its kind at any graduate school in the Southwest was instigated by John McCamish and will be administered by the Law School. Members of the class will be kept posted concerning its progress. The ultimate disposition of the proceeds from the fund will be determined by Class vote at the 1991 reunion. 171 THE SPORTS 172 The Intramural Program Co-Chairmen Delbert Cox, Menton Murray, John Greenfield Intramural sports are intended to afford an opportunity for athletic participation and competition for all interested students, as well as to cultivate physical ability and potential. The rounds of competitive team play emphasize and stimulate a social bond that characterizes the Bar. Through the development of a fondness for sports and organized physical activitiy, the monotony and strain of the academic program can be relegated to its proper time and place. The School of Law continues to make the program more attractive to larger numbers of teams and individuals. The year-around schedule of outdoor and indoor sports reaches all possible interests and abilities. There is no premium placed on particularly accomplished athletic development, rather the intention and practice is to offer something to everyone who is willing to express an interest. The 1965-66 year has seen a record set for the number of fraternity and independent teams in active competition. The program included Summer Soft-ball, Fall Football, Fall Basketball, Volleyball, Spring Softball, and Bowling; a bonus summer golf tournament is offered the entire School. It speaks well for the School that over fifty teams were active in the leagues in the various sports. THE HONORS rk i k V'l 01 I v Miss Roxanna Garcia Portia The Society of the Pcregrinus sponsors a popular election each year to determine which girl, a fellow student, is most deserving of special recognition for her charm, grace, wit, and beauty, as well as for her intelligence. That girl selected reigns for the year as the Portia of the School of Law, representing the school at the various university functions. The 1966 selection of the Portia is Miss Roxanna Garcia. Portia, the title, is taken from Shakespeare’s Merchant of Venue, in which the popular heroine, Portia, possessed of the admirable feminine virtues, argued law and equity in the defense of her suitor. The suitor, in dire need of funds to pursue the courtship, secured a loan through an ill-advised companion. The security for the loan was. a pound of flesh, forfeited in the case of default. In the suit brought in the court of the Duke of Venice, Portia, disguised as a learned Doctor of Laws, cogently argued that This bond doth give thee here not jot of blood; the words expressly are a pound of flesh. Take then thy bond, take then thy pound of flesh; but, in the cutting of it, if thou dost shed one drop of blood, thy lands and goods arc by the laws of Venice, confiscate unto the state of Venice.” She further pled for the plaintiff to join her in a motion for dismissal. The purpose of the Chancellors is to honor and reward by election those students who, through combination of consistent scholarship, personality, and achievement, have shown themselves most likely to succeed and become a credit to their profession and their alma mater. Selections are made in the second semester from the second-year class and in the first semester from the third-year class. The Order of Barristers is limted to no more than five graduating seniors who arc selected by the Faculty Committee on the Moot Court. Hach Barrister has made a unique and noteworthy contribution to the Moot Court Program in both its administrative aspects and its competitive role. In a sense, these five students symbolize all those students who have put in agonizing hours writing, preparing, and arguing briefs before moot tribunals. The)’ reflect the finest qualities of the spirit of competition which is the very essence of the American adversary system of justice. In addition to the Barristers, those students who have made significant contributions to the Legal Research and Writing Appcllatc Advocacy Program, coordinated and administered by the Moot Court Board, will be presented book awards. The presentations will be determined on the basis of: Faculty Recommendation; Dedication of time, energy, and talent; and Students' Progress and Proficiency. Senior Teaching Quizmaster. 191 Annually, the Consul Award is conferred by the Society of the Pcrcgrinus on twelve or more students who have distinguished themselves by the quantity and quality of their extracurricular activity and participation. Lest the award become merely a vehicle for recognizing the number of activities a student enters, positions of leadership, or participation in name only, a committee of student leaders nominates and selects on the basis of positive good done for the School of Law and for the student body. The test for conferral is, thus, positive contributions and service, through extracurricular activities, for the good of the School of Law. After exhaustive evaluation, with the advice of the Dean, all deserving nominees arc added to the roll of Consuls. Many factors shape the standard by which the nominee is measured, while no single consideration is held determinative. Scholarship, initiative, personality, contribution, energy, responsibility, integrity, and service arc some of the tests applied. The Consulship is designed to fill the void left after those awards based on scholarship and co-curricular activity are made, while even this is not an exclusionary feature when the individual can evidence extracurricular contributions. Smith, III Teaching Excellence Annually, representatives of the student body select that member of the Faculty who has merited particular recognition for his contribution to the furtherance of academic preparation and excellence. The recipient of the award is selected on the bases of personal involvement in his classroom responsibilities, of his initiative in going beyond the limits of a casebook for the presentation of material, and of his interest in the advancement of the state of legal training. To be considered, the nominee must have demonstrated the ability to inspire and to stimulate students to put forth more than the passing minimum effort, as well as an interest and facility in his material. The recognition, accorded an individual, is in a larger sense a manifestation of the recognition and respect that is accorded the entire Faculty for its many contributions to the University of Texas School of Law.
