Sellingsloh Note Editor Editor-in-Chief James P. Lee Comment Editor The Texas Law Review was incorporated as a private corporation in 1922 by Ireland Graves, Ira P. Hildebrand, and Leon Green to publish a legal periodical for the benefit of the students and faculty of the Law School of the University oi Texas and of the Bar of Texas. Since the publication of the first issue in December of that year, the Review has achieved a high place in the field of legal periodicals. It is devoted to scholarly articles of general and local legal subjects and to notes and comments on recent decisions of the courts. These notes ana comments are prepared by law students who are members of, or candidates for membership on, the editorial board. This work is supervised by the student officers of the board in consultation with the faculty. Members of the student board are selected by the faculty. ORDER OF COIF The Order of the Coif is an honorary legal fraternity having chapters in top-flight law schools over the country, and a host of distinguished lawyers on its roster. Members are chosen from the ten per cent of each senior class who attain the highest rank in law school work and, in addition, are required at Texas to have performed outstandingly on the Law Review. Each year one honorary member may be named by the chapter; the most recently installed members at Texas are Associate Justice James P. Hart and Mr. Justice Tom Clark. These choices are in the best tradition of the Order, since it takes its name from a respected body of English lawyers who for generations staffed the courts of England and shaped her common law. The fraternity expanded very rapidly and at this date more than 70 law schools have active Delta Theta Phi Senates. Sam Houston Senate of Delta Theta Phi was established at the University of Texas in 1917, the first such organization at the school, and the local Senate now has more than 400 alumni. Even though my examination papers sometimes tend to support this allegation, the birth of Texas Dicta amply demonstrates its lack of factual basis. This is so because Texas Dicta is entirely the result of student imagination and enterprise. No faculty finger pointed out this task to unwilling victims. This paper is, because students wanted it to be. In a larger sense, a school is only what the students make of it. When they strive for a better school, there is a better school; when they dwell in sloth, so dwells the school. The realization of ©independence upon the students makes my felicitation to the Dicta extremely heartfelt and sincere. Good luck and may success attend your future. Your success will be a success for all. J. T. A. TOBIN CROCKETT ENGLISH Judge W. S. Simians’ Own Story of Peregrinus Valeat res ludicro. Horace. You ask for the origin of Peregrtnus. I well remember Ita birth, — In fact I was present at the accouchement. This nondescript sprang fully armed and equipped for Its mission not from a mental Jove, but from the disordered brain of a Savage. Many years ago I was trying to explain to the class in Equity, the origin of the system in Rome and the sources of Equity In the Roman Empire. At that time fledglings Just from the high schools were admitted to the Law School. Many of them bad never heard of the Roman Empire, and not a few spelled cow with a K.” They often reminded me of the school boy who when asked by his teacher, when Qeorge Washington died, exclaimed. “Is be dead? I didn't know the Old Quy was sick. Well. I explained to them that when Rome conquered a nation It was Incorporated Into the Roman Empire subject to Its own laws and not to the laws of Rome — that the Roman cltlxen was not subject to the laws of these Incorporated nations, — that in due course commerce sprang up between the citizens of Rome and the barbaric nations, and there was no law to determine and settle their contractual relations. The Roman Emperor, to settle the troubles arising out of the fact that there was no law applicable to control their contracts, appointed a Praetor or chancellor to travel among these nations and to settle all disputes without reference to the laws of Rome or of the Incorporated Nations, but to do Justice and decide all disputes, alone by the conscience of the Praetor. Peregrinating from one nation to the other, he was called a Praetor Peregrinus. The bonehcade of the class evidently thought that a Peregrinus was an internal organ of the body, for they continually greeted each other, 'How Is your Peregrinus today?' This fact seems to have developed the humorous side of the Incident, and Russell Savage developed a concrete expression of it on the black board, and thus the tradition began. Russell drew better than he knew, for the nondescript animal symbolizes both In limb and attitude the maxims In Equity that guide the administration of the system. For Instance, on one of the front feet as originally drawn was an Irish ditcher's boot, — Indicating the law's protection to the least of mankind. On the other front foot were naked claws. Indicating that the greatest of mankind must fear Its power. The arched back In the attitude of springing. Indicated that the law was ever ready to protect right or prevent wrong. The sharp beak Indicated the power to penetrate the mysteries of the law, which the true student must obtain by study. The bushy tall Indicated that Equity brushes away the technicalities of the law and does Justice on the merits.’ Et voild justement comme on tcrit rhittoirc. Voltaire. — Reprinted from H. Y.
