Stayton In recognition of his distinguished services to the Texas Bar, and in particular to the last 25 classes of The University of Texas School of Law CHARLES TILFORD McCORMICK Dean of the School of Law, 194049 During his tenure, Dean McCormick has supeivised the legal education of more students than any other University of Texas Law 'Dean. The position of esteem which the School occupies among members of the Bar and the respect with which it is regarded by legal educators is due in no small amount to his unexcelled ability as a professor and legal scholar and to his foresighled approach to the problem of how best to train future lawyers and judges. In order to devote more time to legal scholarship, Mr. McCormick has resigned as Dean; but it is the good fortune of students yet to explore the fields of evidence, federal jurisdiction, and damages that lie will remain at the School as Professor of Law. As a mark of their affection for him, students in the Law School entered his classroom in a body during his last class hour as Dean of the School. It all came about svhen a few students, their minds sharpened In hours spent hi local alcohol-eries, decided that a yearbook svas among the needs of the University Law School. Grandiose plans ssere conceived, only to lie discarded upon investigating costs of production. Sights svere then losvercd, and the hook you are miss reading is the result of this paring down, planning, and hour upon hour of work which svas ofttimes tedious, usually fun. When the matter of a name came up, only one choice svas available - it would have to lie named for Lass School's patron saint. Naming it svas easier than relieving its poverty. Since the book is not underwritten by any school or private funds, it ssas imperative that it pay its ossn way. More than 600 subscriptions were sold to students, who, like the staff, hud a great deal of faith and hope that the result would be worthwhile. hi order not to compete ii any sense with the Cactus, University annual, the staff decided not to go ii for high-pressure advertising selling. And so was bom Volume I of The Peregrinus. It h imperfect; undoubtedly there are errors; certainly it K not as large as we would have liked. We especially regret having to omit a history of The Law School. Perhaps future editions will contain such a history. But we believe you will find it valuable to have around for years to come. When, in your dotage, sou prepare to go to the Bar Convention, sou can drag out Pern and try to tie n some names and faces which sou otherwise would probably never have correlated. Simkins, or Old Simp,” as lie was atfeclionately called by Ihe students in his classes, was probably the most colorful character ever connected with tlie School of Law of the University of Texas, llis reign of thirty years began in September, 1099, and ended with his death ki 1929. As a Cadet ki the Citadel, an exclusive military school of Charleston, South Carolina, he is said to have had a part ki firing the first shot at Fort Sumter ki 1861. hi the war that followed lie performed many daring exploits and wound up with a Confederate colonelcy. During the Reconstruction period, lie and his older brother, E. J. Simkins, organized the Ku KIux Klan ki the state of Florida. One of his exploits as a Klansman occurred when a train loaded with arms was being sent into Florida for the use of Negro and carpetbag troops in their efTorts to suppress the Klan. The story goes that the Simkins brothers, with a few faithful followers, boarded the train en route at a station ki Georgia, and broke and tossed out of the cars every musket, together with the ammunition to go with them. Only an empty train arrived at the destination. After Reconstruction the brothers went west lo grow ip with Uie country. They established themselves at Corsicana, where they successfully practiced law until tlie older brother, E. J. Simkins, was appointed lo the Court of Criminal Appeals ki 1892. Thereafter Colonel W. S. Simkins practiced law ki Dallas until his election by the Board of Regents as professor of law ki tlie summer of 1899 It was duiing his first year as a professor of law, llial a slip of the tongue or a mispronunciation by Colonel Simkins, coupled with die fervid imagination of a senior law student, gave die students of die law scitool die patron saint on wiiom they have poured out Uieir love and their loyalty for half a century, and will probably continue to pour diem for a century and a half longer. It all came about ki this way. Tlie Colonel ki his course ki Equity Ind occasion to trace die origin and development of this branch of die law. lie explained that ki die early centuries of die Roman Republic, a judge or judicial officer, known as die Praetor Urbanus, enforced die written laws and edicts upon all persons within die realm. But as trade and commerce grew and more and more foreigners visited die growing metropolis, die Romans found it desirable to settle disputes ki which foreigners were involved, by a more flexible system of laws, based on die principles of natural right dial are said to have been written by die finger of God on die hearts of men. For die pui-pose of ..administering Otis more universal law die Romans appointed a judge known as die Praetor Peregrinus. Now, ki referring to Oris official, die Colonel pronounced die word Peregrinus as though it were spelled Peregrinoos, with die accent on die noos. Tlie next morning after this lecture, when die class assembled, diey saw ai die blackboanl a drawing, by Russell R. Savage, a member of die class, depicting his concepUon of die Peregrinoos, a creature like unto which nodring ever existed ai land or sea. Tlie critter, some three feet long and twenty inches tall, liad a bushy tail and a back as high as a tom cat's when lie prepares to do battle for his lady love, llis long snout resembled die beak of a stork, but die jaws were aimed with vicious fangs. Oil his front feet lie wore men's shoes, and die hind feet were encased ki boxing gloves. This nondescript creature, which quickly became known as die Peregrinoos, soon appeared upon die pennanLs and banners of die law classes, and became die battle flag of die Lawyers ki their fights with their haled rivals, die Engineers. Later a grand image of die Peregrinoos was nuk? of papier-maclie and mounted on a heavy pedestal. It was kept ki die Dean's office and was only brought out for die annual banquet cr other state occasions, and always under guard. However, cn one occasion die guard was overpowered, and die sacred efligy was borne away ki triumph by die enemy, and cut to pieces, and die pieces distributed as souvenirs. But an even grander image was produced and kept locked in a bank vault, and even strongr guards attended its appearance ill llie annual banquet. And by way of retaliation, the lawyers captured llie Engineers' patron saint, Alexander Frederick Claire, and had pictures made of him ki a pigsty. The contagion of the name Peregrinoos spread. Not only was it applied to llie sacred elligy, but llie Colonel himself did not escape, but was often referred to as Old Peregrinoos, or Perry,” lor short. And llie law-class yell ran Rah, rah, rah - Rah, rah, Roos Simpkins, Simpkins - Peregrinoos Laws! Laws!! Laws!!! Another early incident helped greatly to endear U e Colonel to llie sporting element of llie law school. These enterprising youngsters, noticing that llie Colonel was usually several minutes late coming into llie classroom, fell a strong uige to pul his green-topped desk to some appropriate use. Accordingly a small kiwi of them gathered around llie desk, and the bones” began to roll. Each day tl e group around llie desk grew larger and Uie stakes became more juicy. To prevent surprise a listening post was established, and, when Ute lecturer was heard approaching, llie dice and llie money quickly disappeared, llie boys slid into their seals, and, by llie time llie Colonel readied his desk, they were all poring over their books in righteous studiosity. Sometimes their plan failed to work, but llie Colonel never mentioned what lie may have seen or heard. Nevertheless llie goings-on finally readied llie 'ears of Dean Townes and llie culprits were summoned for a hearing before the faculty. Arter a few witnesses liad been examined, the Dean turned to Colonel Simkins and asked him a few questions: Had he, ai entering his classroom on several mornings, noticed the boys gathered about his desk? Yes, 1b had. Did he know that some sort of game was being played an his desk? Yes, Ib did. But, 1b added, with a sly wink at the defendants, I thought they were playing tit-tat-too! The hearing got nowhere, but the Colonel's stock experienced a sudden bull market ai llie campus, espe- cially with llie seven-eleven boys. For many years, Colonel S'imkins lectured to llie class in Contracts, a large and rather boisterous group of first year students. On one occasion the class bell at llie noon hour rang before the Colonel had finished his lecture. When 1b calmly ignored llie bell and went right ai with his lecture, llie boys became restless and began to shuffle their feet on the floor. Still Uie Colonel ignored tliem and went on more vigorously than ever. Just then a donkey, which someone, possibly with malicious intent, liad tied to a tree near llie law building, opened ip in a voice that could be Itcaix! a mile away. When the music outside liad ceased and llie uproar inside liad partially died down, the Colonel shouted, Get out, you young jackasses! Your brother's calling you to dinner. As 1b bent low over Uie desk ai his office preparing his lectures or Uie manuscripts of his many published law books, 1b usually liad ai unlighled cigar in his mouUi - destined to perish by flood rather than by fire. On one occasion when passing Uirough Uie law building, Ib cime upon Uiree a- four young jackasses idling in a classroom, at an off-hour. In Uie middle of Uie group Ib noUced a puddle of ambeer ui Uie floor. Assuming his fiercest mien Ib demanded of Uie nearest boy: Henry, did you spit on Uie floor there? No, Colonel, said Henry abashed, I didn't ib that. Frank, did you spit ai Uie floor? No, Colonel, said Frank, “I didn't cb it. George, persisted Uie irate Colonel, did you cb that? Cornered at last, George shifted his cud, swallowed hard, and said, Yes, Colonel, I did. Then, give me a chaw of tobacker, said Uie Colonel, as Ib broke into a laugh. George wras so greatly relieved that Ib felt like giving him Uie wliole plug. Many interesting stories cluster about Uie Colonel aixl his ■© II.P. Hupp, a powerful car for that day. He named it Old Equity, for Uie reason that Ib paid for it with Uie profits from his first book, Simkins ai Equity. In one of his first escapades wiUi Old Equity, Uie Colonel found himself sitting m his neighbor's lawn wiUi Uie rear wall of his own garage draped about him. The brakes didn't hold, Ib explained wiUi a sheepish grin. His foot liad f)und Uie accelerator Instead of Uie brake-pedal. Nothing he ever dkl seemed lo give the Cnlond more exhilaration than driving that opal car at a furious rate with his white hair, which he wore down to his shoulders, a h Mark Twain or Buffalo Bill, streaming out behiixl him. Ch oik occasion Ik whizzed down Congress Avenue and made a short left turn into Sixth Street. 11k trallic cnp ii the mkkDe cf the Intersection - Austin's first symptom of binkling dl )hood - blew his whistle furiously ;xxl demanded that the Colond back ip ;uxl drive around him. 'Til cook IxkJs tomorrow and drive around you, the Colond shouted over his shoukler as lie stepped on the accelerator. A similar incident occurred in Dallas when 11k Colond first drove his Hupp fc that North Texas iiKtropolis, over Uk 3fX) mik s of narrow, crooked, nnxldy roads. How many runaway teams aixl wrecked fann wagons lie left scattered along the way Uk chroniclers d not tdl us. But after he reached Uk city lie enjoyed Uk paved streets aixl Uk excited pedestrians. The traffic cop at Main arxl Akard, the busiest crossing ki the city, sought to halt him. Get xit of the way, young man, shouted the Colond, or I'll mn over you! '11k command was instantly obeyed, aixl another life was saved by the Colond's foresight. Some years later, when his very good friend from Alaska, Rev. Hixfcon Stuck, Anil Dean of Uk Yukon, foniK r LXan of SL Matthews' QiUK dr.d ki D-allas, came lo Austin for a visit, the Colond took him out for a ride ii Uk country. His driving was like Uk driving of Jehu. After fifteen minutes of bouncing over Uk boulders ii Uk hills north of the city, the LXan asked Uk CoIoikI In stop Uk car. Wlxn the wheels skidded lo a stop, Uk Dean got out of Uk car aixl started Ixick toward Austin. Where are you going? asked his host. Colond Simkins, said lie, I've braved the terrors of Uk Alaskan winters, aixl I've conquered Mount McKinley's twenty lliousand fed of snow aixl Ice, lx 1 can't stand your driving-1 simply ain't take it. 1 an walking Ixxk lo Austin. Another life was saved - lx this Uiik by the Dean's foresight. One of Uk ColoneTs weaknesses was his fondness for applause. It was a part of his nature. It manifested itself li many ways. His late lx hurried entry into Uk dassroom, wiUi a shake of his kmg while locks, like the leading actor's entry m Uk stage, was exjiected lo draw a round of applause. It always tiki '11k kind dapping Uiat greeted his entry ki Uk early days of his service, gradually gave way as Uk years jxissed lo yelling ; xl |xiunding of books on desk tops - a momav tary uproar that could h heard all over the campus. Oi oik occasion Uk boys decided to play a trick on the ColoneL ‘Ihey agreed among themselves I lull his entry at Uk next class slioukl be greeted by complete silence. This conspiracy was carried out |K rfectly. As Uk astonished Colond took his seat aixl glanced around Uk room at the sok mn faces, Ik ileiiumded, What's Uk matter with you young jackasses? Have vou lost your voices? 'Ibe roar of applause that greeted this sally fully answered his qiKslion. Not long afterwards Uk Colond proved that he too couki play tricks. It auiK about ii this way: each year when the class readied a particular place in his course in liquity, he would give than :n lioiir's written quiz. As Uk years passed 1 became amnion knowledge about Uk sdiool that Uk questions used were always the same. So as the time for the quiz drew ixxir Uk students worked up carefully the answers to these questions, aixl gave little attention lo the rest of Uk course. ’Ibe quiz, master, being a conscientious man, called Uk Colond's attention lo the situation and urged him lo make a new set cf questions, but the Colond said m Qi quiz day the students were greatly pkased In see Uk aid familiar questions. Ihey kxl visions of the posted grade sheet witii big fat A's after their names. Imagine, then, their chagrin when a string of T's appeared where Uk A's slioukl have been. Ai indignation meeting ap| ointed a committee lo wait cn the ColoneL 'Ihey | ointed out to liim that they kxl learned that the questions were Uk same as Uiose cf the previous year aixl their answers were substantially the same. lhai how, they asked, was it possible that they kxl all made T's whai Uk previous class kxl nxxk A's. Ok yes,” said Uk Colond, the questions were the saiiK all right, but 1 have changed the answers ai you! 'Ihey all joiiKd ki his infectious laughter. '11k incident was closed, lx Uk T s still stood. Colond Simkins was foixl of innocent sports of all kinds. It was usually a roisterous gallery that gathered ;ur und the billiard table at tlx University Faculty Qub to see Okl Simp and Sut-tonius (Prof. W. S Sutton) struggle lor the dub championship. The Colond usually won, ;uul Ixkl the championship ii |ool as well as at billiards until advancing years dimmed his eyesight and unsteadied his hand. The Colond was also ai adept at cards. )ohn A Lontax, America's leading collector ot ballads, still enjoys telling of their games, when lie and the Colond were matdied as partners against the Colonel's two daughters, Elizabeth and Hden. From time to time tlx. Colond would break Into good natured railcry at his partner's stupid plays: Did anyone ever have sixJi a nitwit tor a partner! John, you might make a good wooden Indian for a cigar store, lx you'll never know anything about cards.'' Now, Lomax, who served long years first as registrar of the University aixl later as secretary o-the ex-students' association aixl editor of their monthly magazine The Alcalde, became in his day a sort of father confessor to all sorts of peopk hi trouble, faculty and students alike. President Mezes once called I tin a heart specialist, at expert in smoothing out troubled human rdMions. Aixl such the Colond found Itim what trouble overtook him. Soon after the Colonel Itad passed his four score mile stone, the University Regents having no retiring system, reduced both his teaching load aixl his salary, by fifty percent. Worse still, the action was taken without any notice whatever to the Colond. Naturally it cuix as a great shock to the okl war horse, and he turned to his friend Lomax for hdp aixl comfort. He explained that lie Itad saved little or nothing from his salary aixl that he aixl his daughter woukl have difficulty in living ai the stipend left to him. Lomax promised to look into tlx. matter aixl see what, if anything, coukl be doix about iL Accordingly, he arranged a conference with the Acting President. Ffc soon saw that he was getting nowhere, so he played his trump card. FL woukl publish in The .-l.lcakk an appeal to the okl Law students who Itad studied under tlx Colond, to send Imii contributions to a fund to enable tlx (okxxi to live out his days in comfort. Tlx President protested, and finally forbade tlx publication, '.fhereupon tlx Lditor rose ip ii righteous wrath. Hl informed the President that he was not taking orders thxn the President of tlx University, dial lx !x ki his po3illon by election of the directors rf tlx Ex-Students' Associa- tion, aixl was responsible to that boil)- only for what lx publislxd in The Alcalde. The appeal was published. While sonx alumni sent ii checks, most ot them lunxxl loose on the President and Board a storm of protest that speedily got the desired result-the Ikxird at its next meeting reversed iLs action and restored the major |X rlion of tlx salary cut. Toward the aid of his career, when he was well 141 ii tlx eighties, tlx Colond had a slight heart attack in tlx classroom. The boys got him into a car and drove lam directly to his honx ai Rio Grande Street. HLs daughter, Elizabeth, Mis. Harris Masterson, who was his housekeeper and ever- watchful caretaker, happened to be away from honx at the moment, but Mrs. CampbdL wife ot I n lessor Killis Campbdl, who Jived directly across tlx street, taking in tlx situation, hurried over to render any service she might. When the Colond saw her, lx said, Get my whiskey, there on the closet shelf. When she brought tlx bottk lx turned it ip and took a long swig with evident relish. A few minutes later the doctor, who had been summoned, arrived and, after a hasty examination, ordered Mrs. Campbdl to give the patient a tablespoonful of whiskey. Without a word ot what hxi just Itappencd she carefully measured out a tabk-sjxtonful aixl administered it to tlx patient, all tlx time wondering whether she Itad killed him. A short time later, after another examination, the doctor left, assuring those present that tlx Colond woukl be all right, aixl marveling at the patient's speedy response to his treatment. But I was clear that tlx Colonel's strength was falling. Many years ago I was trying to explain to Uie class In Equity, the origin of the system In Rome and the sources of Equity In Uie Roman Empire. At that time lledglings Just from the high schools were admitted to Uie Law School. Many of them had never heard of Uie Roman Empire, and not a few spelled cow with a K. They often reminded me of the school boy w!k wIkmi asked by his teacher, when George Washington died, exclaimed, Is lie dead? I didn't know the Old Guy was sick. Well, I explained to them that when Rome conquered a nation it was Incorporated Into Uie Roman Empire subject to its own laws and not to Uie laws of Rome - that Uie Roman ciUzen was not subject to Uie laws of Uiese incorporated naUons, • Uiat ki due course commerce sprang between Uie ciUzens of Rome and Uie barbaric nations, and tiiere was no law to determine and settle their contractual relations. The Roman Emperor, to settle Uie troubles arising out of Uie fact that Uiere was no law applicable to control their contracts, appointed a Praetor or chancellor to travel among these nations and to setUe all disputes without reference to Uie jaws of Rome or of Uie Incorporated Nations, but to tb justice and decide all disputes, alone by Uie conscience of Uie Praetor. Peregrinating from one naUon to Uie other, lie was called a Praetor Peregrinus. The boneheads of the class evidently thought that a Peregrinus was an internal organ of Uie body, for Uiey continually greeted each oUier, 'How is your Peregrinus today?
